“Should I have an LLC or an S Corp?” 🍎🍊

That question comes up all the time, but it’s often comparing apples to oranges.

Your business structure and your tax treatment are two different concepts.

For example, a Florida LLC may elect to be taxed as an S Corporation if it qualifies. That tax election does not turn the LLC into a corporation under Florida law.

This is also why your business attorney and CPA may be talking about different pieces of the same puzzle. Your attorney can advise you on the legal structure, while your CPA or tax professional can advise you on the tax implications and appropriate tax treatment.

Did you know an LLC could be taxed as an S Corp and still remain an LLC?

Starting a business? Don’t let the legal side be an afterthought.

There’s a lot more to building a solid foundation than registering an LLC and opening a bank account.

Depend depending on your business, your legal starter kit may include governing documents client contracts, website, policies, employment, or independent, contractor agreements, and vendor agreements.

You may not need every document on day one but you do want the right protections in place before a disagreement, unpaid invoice, employee issue or other problem forces you to think about them.

The goal isn’t paperwork for the sake of paperwork. It’s creating clear expectations, protecting what you’re building and giving your business room to grow.
