As I have told many, it has been total propaganda about lawyers and litigation killing Florida’s property insurance market. Floridians have no practical defender or response to underpaid or improperly denied claims not that our legislature gutted our protections last year. See the attached findings and what is not amongst the reasons for the insurance carrier insolvencies in Florida.

All Florida property owners and insurance premium payers need to let your elected senators, representatives and other officials know, that you demand the attorney fee statute proving fees if your insurance carrier improperly adjusts or denies your claim, to be reinstated.

P.S. premiums continue to rise and there is no indication that will level off or stop this year, next or anytime soon thereafter.

Despite years of complaints from Florida property insurers and some lawmakers that out-of-control claims litigation was destroying the industry, recent regulators’ reports about the reasons for insolvencies make little mention of the “L-word.”

Pleased to report that Leader, Leader & Zucker, PLLC had the privilege to represent a very lovely couple that bought a home to have a family and insured it with Citizens. About 18 months later Tropical Storm Eta passed and damaged their home. Citizens refused to pay the claim alleging it was uncovered damage from flood water. Two plus years later in litigation, Citizens own expert admits that there is no evidence to support ground/flood water. Citizens still persisted to trial. After four days of trial, the jury returned the only correct verdict, every penny our clients sought. In fact, the jury wanted to know if they could award more! Nice to see justice really does happen. Our clients were on the side of right and the jury recognized it with a prompt verdict.

It was a great trial. Not one objection during testimony in four days and a stipulation to the admission of almost every exhibit. Pleasure to work with professional lawyers and good judges!

Days like today remind me why I do what I do. Our clients in this case could not be nicer people. So happy for them! &ZUCKER,PLLCTRIALLAWYERS
