Can you be arrested for DUI in Florida if you are legally parked and have no intention of driving? Unfortunately, the answer is YES. In Florida, the State (Prosecutor) must prove that the Defendant drove or was in actual physical control of the vehicle. Therefore, if you are sitting on the driver's side and you have the keys to the car, the State can prove that you are in actual physical control. The State does not have to prove that you were driving. You would have a great argument for acquittal at trial, though. For anyone that currently rents an apartment or home (Residential), A landlord must, within 30 days, give you notice of the Landlord's intention to impose a lien on your security deposit. The Landlord could be responsible for your attorney's fees. We handle these types of cases usually with NO attorney's fees upfront. Here is part of the Florida Statute.
Upon the vacating of the premises for termination of the rental agreement, if the landlord does not intend to impose a claim on the security deposit, the landlord must return the security deposit, together with interest if otherwise required, within 15 days after the termination of the rental agreement. If the landlord intends to impose a claim on the deposit, the landlord must, within 30 days after the termination of the rental agreement, provide the tenant written notice by certified mail to the tenant’s last known mailing address or by e-mail in accordance with s. 83.505 of his or her intention to impose a claim on the deposit and the reason for imposing the claim.
