Many Florida homeowners assume they have only two choices when a property insurance claim becomes a dispute: accept the insurer's position or file a lawsuit.

There's another option.

Mediation is a confidential process where the homeowner and the insurance company meet with a neutral mediator to discuss the issues, evaluate the information, and explore whether a resolution is possible.

Property insurance disputes can arise for many reasons. Sometimes it's a question of coverage. Sometimes it's the scope of the damage, the cost of repairs, or delays in processing a claim. The disagreement may involve hurricane, wind, water, roof, or other property damage.

A mediator doesn't decide who is right or wrong. The mediator doesn't interpret the policy or impose a settlement. Instead, the mediator helps both parties have a productive conversation and, when possible, reach their own agreement.

Not every case settles in mediation, and not every dispute is appropriate for mediation. But for many homeowners and insurers, it offers an opportunity to resolve a claim more quickly and with less expense than litigation.

If you're in Broward, Miami-Dade, or Palm Beach County, or anywhere in Florida, and would like to learn more about the mediation process for property insurance disputes, I offer a complimentary 15-minute consultation to explain how the process works and answer your questions. There's no obligation, and no need to discuss the details of your claim.

Most landlord-tenant conflicts that reach a crisis point didn't start as one.

They started as a missed communication. A repair request that went unanswered. A rent payment that was late for a reason nobody explained. A lease term both sides read differently.

By the time an eviction notice gets filed, both parties are entrenched — and eviction court is adversarial by design. It produces a winner, a loser, and a record, but rarely a resolution that works going forward. Even a judgment is just a document saying someone owes you; collecting on it is a separate fight, and for the tenant, it follows them to every future rental application.

So what does the alternative look like?

Mediation is a structured conversation. Each side states what happened and what they want, then a neutral mediator works between the room and private caucuses toward specific terms — a payment plan, a repair timeline, a move-out date everyone can plan around. It takes hours, not the weeks a court docket runs. It works within the law and keeps everyone's rights intact: whatever you say stays confidential under Chapter 44 of the Florida Statutes, and any agreement can be entered as an enforceable court stipulation.

If you don't settle, nothing is lost — the case moves forward with all your options intact. And the person guiding it is a Florida Supreme Court-certified mediator: a trained neutral with no stake in who prevails.

I've sat with landlords and tenants who came in certain they had nothing to say to each other. Most left with an agreement.

Not because the conflict wasn't real. Because a structured conversation gave them somewhere to put it that wasn't a courtroom.

Divorce doesn’t have to mean a courtroom. And it doesn’t have to mean a judge making decisions about your finances, your property, or your children’s future.

In mediation, both parties make those decisions together — with the help of a neutral mediator who keeps the conversation structured and focused on resolution. The process is private. It typically costs a fraction of what litigation does. And it usually takes far less time.

Mediation works for divorcing couples navigating asset division, couples working through separation, and co-parents who need a parenting plan that actually works for their family — not just one that satisfies a legal requirement.

Both parties have to be willing to participate. That’s the only requirement.

If you’re in Broward, Miami-Dade, or Palm Beach County and want to understand how mediation might apply to your situation, the best first step is a free 30-minute consultation. It’s a process conversation — no case details, no commitment, just information so you can make an informed decision.

If you’re dealing with an HOA dispute in South Florida, here’s something most people don’t realize until they’re already deep in the conflict:

Florida law requires mediation before an HOA can take a homeowner to court — or before a homeowner can sue their HOA. That’s not a loophole. It’s an intentional step built into the process because the state recognizes that most of these disputes can be resolved without a judge.

What does that mean for you?

It means there’s a structured, private process available right now — before attorneys get involved, before court fees accumulate, and before the dispute becomes a matter of public record. Both the homeowner and the association have a voice. Both participate in reaching the agreement.

Agreements reached through mediation hold better than court orders. Because both parties chose them.
