Florida voters could change how local governments fund growth and the impact will extend far past property tax bills.

The state’s proposed Amendment 3 would increase property tax exemptions for qualifying homeowners and lower the annual assessment-growth cap on commercial real estate from 10% to 5%.

While that sounds like a win for property owners, local governments still need to fund the roads, emergency services, and infrastructure that keep communities operational.

If property tax revenue shrinks, cities will have to find other ways to balance their budgets.

Here is what that means for business owners, developers, and local real estate:

💡 Municipalities may rely more on impact fees and municipal charges to cover lost property tax revenue.

🤝 P3s will become critical to funding major infrastructure and public projects.

🚧 Expect tighter municipal scrutiny and longer site negotiations as cities look to close funding gaps.

As Florida voters consider Amendment 3 this November, developers, businesses, and property owners should pay close attention to what the proposed property tax changes could mean for real estate development, local government budgets, and infrastructure investment statewide.

The City of Boynton Beach, Government is moving forward with plans to select RedSpeed to manage its school-zone speed detection and red-light camera programs.

By using a competitively awarded contract RedSpeed already holds with the City of New Port Richey, Boynton Beach can bring on a proven vendor more quickly and efficiently.

RedSpeed works with cities and counties across Florida to help make school zones and intersections safer for drivers, cyclists and pedestrians. As part of the agreement, our client waived its first month of red-light camera fees, saving Boynton Beach $69,300.

Law360 Real Estate Authority turned to Florida's top real estate minds for its midyear outlook on the state's CRE market, and our Managing Partner Keith Michael Poliakoff was among the experts weighing in. Keith shares that one of 2026’s biggest surprises is how quickly older condominiums have become difficult to finance. Heightened state safety and financial regulations are weighing down these properties, making it hard to secure the funding required to bring them into compliance.

Looking ahead, Keith calls on lawmakers to act. While Florida's new condo safety laws have made buildings safer, they have placed enormous financial pressure on many owners. In addition, stricter Fannie Mae and Freddie Mac lending standards are compounding the problem. As Keith puts it, the Legislature needs to address affordability for condo owners, particularly through financing solutions that help fixed-income residents pay the mandatory assessments that keep their buildings safe.

Government Law Group Managing Partner Keith Michael Poliakoff landed the cover story on the Live Local Act in the South Florida Business Journal. Drawing on his work across multiple Live Local projects, Keith points to the pushback developers still face at the local level, citing as an example the ongoing litigation over proposed developments in Bal Harbour, Hollywood and Miami Beach. He calls on state lawmakers to consider further amendments limiting local officials' ability to block or slow-walk qualifying projects.

Keith and other industry leaders agree that Live Local has already sped up approvals and unlocked hundreds of workforce housing units across South Florida. However, reaching the scale the region needs will take continued refinement of the law.
