USCIS has released a new edition of Form I-589 (Application for Asylum and for Withholding of Removal). The updated form is dated July 28, 2026.

Starting August 28, 2026, USCIS will accept only the 07/28/26 edition of Form I-589. Until then, applicants may continue using either the new edition or the previous 01/20/25 version.

For anyone planning to file for asylum, this is an important reminder to make sure you're using the correct version of the application. Filing an outdated form after the deadline could delay processing or result in the application being rejected.
If you're preparing an asylum application, review your forms carefully before filing and make sure you're submitting the edition USCIS currently requires.

The Department of Homeland Security has issued an interim final rule allowing USCIS to refer certain affirmative asylum applications directly to an Immigration Judge without first conducting an asylum interview. The rule took effect immediately.

Previously, many affirmative asylum applicants were interviewed by a USCIS asylum officer before a decision was made or the case was referred to Immigration Court. Under the new rule, some applicants may move directly into removal proceedings where an Immigration Judge will hear their asylum claim instead.

According to DHS, the change is intended to shorten processing times and reduce the large backlog of pending asylum cases. However, immigration advocates have expressed concerns that eliminating the initial interview could reduce an important opportunity for applicants to present their case before entering court proceedings.

If you have a pending asylum application, this rule does not mean your case has been denied. It changes how some cases may be processed, and the impact will depend on your individual circumstances.
