There is no “one size fits all” when it comes to your family law matter, and traditional litigation may or may not be the right fit for you. Recognizing that every family law case is different, Laura Monty Law, LLC is proud to offer Fort Collins and the Northern Colorado region both traditional and alternative family law services to meet the different needs and goals of each client. What are alter

native family law services? Alternative family law services are alternatives to the traditional litigation process. Historically, when a family law dispute arises, a party hires a family law attorney and files a petition or a motion with the District Court asking the court to resolve the dispute. Each party prepares their case, often spending thousands of dollars to hire experts and prepare their case for trial. After a trial, a magistrate or judge makes a ruling on the disputed issue and enters a court order accordingly. While there are certainly cases where traditional litigation is necessary and unavoidable, there are other options out there to assist parties’ in resolving their family law disputes and/or to help parties seek legal assistance at a more reasonable cost. Laura Monty Law, LLC understands that going to court is not the best option for all people, which is why we offer alternative family law services. What family law services do you offer? At Laura Monty Law, LLC, we offer four different services to meet your family law needs:

Collaborative Law

A process where two parties agree to avoid going to court and enter into a contract to resolve their family law dispute outside of court over a series of sessions with the help of collaboratively trained family law lawyers. Mediation

An alternative dispute resolution process where two parties work with a neutral mediator in an attempt to reach agreements to resolve their family law disputes outside of court. Unbundled Legal Services

A la carte services where a client and attorney agree on discrete tasks that the attorney will assist the client with, such as reviewing documents, legal research, or assisting the client to understand the legal process. Traditional Litigation

Traditional litigation is by far the most common method used to resolve family law disputes. Traditional litigation refers to initiating a case—whether it be a divorce, child custody, or other family law case—with your local district court so that a judge or magistrate can resolve the dispute for you. How do I know what service is the best for me? When you are considering which service is best for your family law case, you should consider several factors, such as your relationship with the other party, whether the other party is willing to work with you to reach a resolution outside of court, the tone that you would like to set when raising the dispute, and your budget. You may also want to consider whether your dispute is purely financial, or whether children are involved, and if so, how the court process will affect them. However, the best way to determine which service is best for you is to set up an initial consultation with Ms. Monty to discuss your goals and objectives as well as the pros and cons of each service.
