Another short payoff settlement achieved for a client that owns a two family home in Corona, Queens. Our client has been in default on his mortgage payments since 2008. The bank previously commenced a foreclosure action in 2009 which was subsequently discontinued in 2013. The bank commenced a second foreclosure action in 2017. Our client's previous attorney lost on its motion to dismiss the 2017 foreclosure action. Our client hired us, we filed an appeal to seek to overturn the decision of the lower court on the basis that the Bank's claim was time barred on the six year statute of limitations. While the appeal was pending, partner Ariel Poltielov, Esq. was able to negotiate a very favorable short payoff settlement. We were able reduce the outstanding mortgage balance by $485,443. We then helped our client find a lender that agreed to extend financing on this foreclosure bailout and we closed the deal on September 1, 2020.
