Did the June 23, 2026 U.S. Supreme Court decision of 6-3, in Blanche v. Lau, 609 U.S. —— (2026), get it right when it held that the Department of Homeland Security (DHS) can stripe Lawful Permanent Resident (LPR) or Green-card holders of their lawful permanent residence status if they leave the U.S. while a criminal charges are pending against them, would be treated as returnees who are seeking admissions into the U.S.? You tell me please, while taking into consideration the fact that applicable Immigration and Nationality Act (INA) and the Department of Homeland Security (DHS) internal policy, rules and regulations do not require the Immigration and Customs Enforcement (ICE) and Custom and Border Protection (CBP) officers to have “clear and convincing” evidence that an LPR or green-card holder has committed a crime of moral turpitude before the officer treats the LPR returnee who has pending criminal charges as an applicant for admission into the U.S.
