LAWYER TIP OF THE DAY: I have spoken many times about the need for a simple will. I cannot stress the importance of it. What I would like to discuss is the “do it yourself people.” In my years of practice, I have encountered hundreds of instances where family members of a decedent prepared quitclaim deeds from blank forms off the internet or other sources, and have conveyed family land in an attempt to satisfy probate. This does not satisfy probate. In fact, many times it makes probate more difficult as the deeds may be wrong. There is a reason professionals go through years of training to do these tasks. Please trust professionals on issues as important as your land, your inheritance, your family’s future.............................. As I tell my clients, you can do heart surgery on yourself, but probably isn’t a good idea.

LAWYER TIP OF THE DAY: If you find yourself in arrears to your mortgage company for your home loan, do not bury your head in the sand. You need to be proactive in every move. Immediately contact your lender upon the very FIRST delinquency. Many lenders have loss mitigation programs that may help, but they take time so immediate action is required. If you can’t work it out quickly with your lender, you may want to consider selling your home to protect your equity. If you do this, let your realtor know up front that you are behind in your mortgage. If you intend to keep your home, you may have to file Chapter 13 bankruptcy. This process allows you to keep your house and restructure your arrears through payments that go through the bankruptcy programs. You cannot do any of the above if it goes to sale at the courthouse. Once that auction has happened, then it is too late. Most important, don’t be embarrassed or ashamed. Life happens, but there are people that can help.

Lawyer Tip of the Day: If you inherit property, and you properly probate it to place the property in your name, make sure you change the hazard insurance policy, utilities, and any other property related issues or documents. Trying to explain to someone in customer service representative ( that may or may not even be in the United States) that you are now the owner of the property is a nightmare and you will thank me later.

LAWYER TIP OF THE DAY. If you find yourself in financial distress, bankruptcy may be an option. Today I want to talk about Chapter 7 bankruptcy which you can only do every eight years. This is where you generally discharge unsecured debt (certain loans, credit cards, medical bills etc.) meaning you don’t have to pay them. For secured debt (mortgages, car loans, etc.), you have to remain current in them under a Chapter 7 or at least have an agreement in writing with your lender. If you do not, you may have to surrender those items. IT DOES NOT MEAN YOU AUTOMATICALLY LOSE YOUR HOME. There are many ways around this including filing under different chapters. What is of paramount importance is that you seek the help of a bankruptcy attorney as soon as you can as you have to qualify for Chapter 7 based on income. Do NOT trust lay persons, attorneys who do not do bankruptcy (this is an area of law not common to most lawyers), or in a lot of cases......... credit counseling services. There are many fraudulent entities out there that prey on the financially vulnerable. Stay frosty, but there is a fresh start for those who qualify.
