⚖️ FEDERAL COURT ORDERS USCIS TO RESUME PROCESSING CERTAIN IMMIGRATION CASES

A federal judge has blocked portions of a USCIS policy that had resulted in delays or holds on some immigration benefit applications.

The court ruled that USCIS cannot indefinitely suspend adjudication of applications without proper legal authority. As a result, certain cases that were previously delayed may now move forward.

IMMIGRATION UPDATE: GOOD NEWS FOR ADJUSTMENT OF STATUS APPLICANTS

Over the past week, many immigrants, families, and attorneys expressed concern regarding USCIS's recent memorandum discussing the agency's discretionary authority in Adjustment of Status (Green Card) cases.

When the policy was first announced, many feared it could represent a major shift in how green card applications would be adjudicated. However, recent reporting suggests that the memorandum may be far more limited than originally believed.

According to statements attributed to government officials, the memorandum appears to be intended primarily as a reminder of USCIS officers' existing discretionary authority rather than a sweeping change in immigration policy.

What does this mean for applicants?

At least for now, there is no indication that every Adjustment of Status case will suddenly be subjected to a dramatically different standard. Applicants should continue focusing on what has always mattered: submitting complete applications, providing strong supporting documentation, demonstrating eligibility, and presenting favorable equities whenever appropriate.
