"I think I already missed my chance to object." That's what people usually say when they call about a probate notice in Genesee County. They haven't. They're just looking at the wrong deadline.

Michigan uses two different notices, and they run on two different clocks. If you received a Notice of Appointment of Personal Representative, you have 28 days from the date it was mailed, or 14 days from publication, whichever is later, to object to the will or the appointment. If you were served with a summons for a formal Petition for Probate instead, your window drops to 21 days from service, and that petition may already raise questions about capacity or undue influence.

Mixing up which notice you got, and which clock is running, is how people lose their window before they even know it existed.

There is a common belief that if law enforcement does not read your Miranda rights, your case is automatically dismissed. In reality, the situation is more nuanced.

Here is a brief overview of what to know:

🔹Miranda rights apply only when you are both in custody and being questioned.
🔹Not all police encounters, like traffic stops or brief questioning, require Miranda warnings.
🔹Violations of Miranda rights may exclude statements from evidence but do not automatically dismiss the case.
🔹Prosecutors can still rely on other evidence, such as witness testimony or physical proof.
🔹However, it does remain true that if key statements are excluded, it can weaken the prosecution and strengthen the defense.

You're sitting in a meeting when your phone buzzes. It's your brother: 'Let's not rock the boat until the estate closes.' He's not the one filing the paperwork.

In Michigan, you don't have to wait for a final accounting to ask what's happening to the money. Personal representatives owe beneficiaries duties of loyalty and transparency the whole time the estate stays open, not just at the very end, and annual accountings are supposed to go out along the way. Courts can compel an accounting, restrict a fiduciary's powers, or remove one for cause, long before any closing statement gets filed.

What raises flags for us is delay. A late inventory. Withdrawals nobody can explain. A 'reimbursement' that doesn't add up. Those patterns matter most while the estate is still open, because that's when assets can still move.
