So you've completed your estate plan. Congratulations! 🎉
That's a great accomplishment. Now be honest, where have you decided to keep the original documents?

Is it in a file folder in your filing cabinet?

Or in a safe deposit box at the bank?

Or is it (eep!) in a pile of paperwork on your desk?

Deciding where you'll keep these documents is just as important as making sure they are up-to-date.

Wealth Management has a fantastic article with four specific recommendations for keeping these documents safe and accessible for those who'll need it when they need it. Take a read. Link to full article below. Here's a quick blurb:

"A complete estate plan includes documents which are to be used in the event of your clients’ incapacity as well as at their death. In both of these situations, it’s important that the individuals named to serve in those documents are aware that the documents exist, where they are located and how they may be accessed. After all, if the original documents can’t be found, they will be of little use. A beneficiary of a will whose original that can’t be located, for example, may be out of luck, if the beneficiary wouldn’t have otherwise inherited under the applicable state laws relating to intestate succession. For example, Virginia law presumes that if an original will can’t be located, its creator destroyed it with the intent that it be revoked. As a result, attempting to admit a photocopy of a will to probate can be a costly, time-consuming endeavor, and there are no guarantees as to whether the copy will ultimately be accepted."

Reminder! You can’t just copy and paste someone else’s liability waiver and expect it to work for your business.

In equine law, we equine lawyers regularly caution people that the legal protections immunizing equine activity sponsors from some lawsuits vary from state to state, and that therefore, you cannot necessarily copy and paste a liability waiver written for one state for use in another state.

A 2024 case from Michigan is a more recent confirmation of this caution.

Excellent resources from US Equestrian:
"Every athlete deserves to be safe and supported. US Equestrian is committed to ensuring that every athlete gets the opportunity to enjoy equestrian sports free from abuse.

US Equestrian encourages all parents/guardians and our minor athletes to take the free training courses that are offered by the U.S. Center for SafeSport. These courses are tailored for each group. The Parent’s Guide to Misconduct in Sport is a 30-minute training video that educates parents on recognizing, responding to, and preventing abuse and misconduct in your child’s sport setting. You will come away equipped with information and tactics to minimize risks of harm, You will also learn what helps create a safe sport environment for your children and what resources are available for reporting.

In addition to the training module for parents/guardians, we encourage viewing The Center’s webpage for Parents and Guardians. This webpage includes important topics and resources, including the Parent and Guardian's Handbook for SafeSport. This handbook provides information and resources to help parents understand the different types of abuse and misconduct, as well as provides tools and tips for talking to their child about sexual and emotional abuse.

The U.S. Center for SafeSport also provides training modules for minor athletes.
If you are between the ages of 13-17, the Center provides a 15-minute course that is focused on bullying prevention, supporting friends who have experienced abuse or misconduct, and resources for reporting.

For those athletes between the ages of 5-12, the Center provides a 15-minute course that helps minors know the difference between discipline and abuse and encourages them to reach out to a trusted adult when something is not right. It also stresses the importance of positive sportsmanship and having a healthy sport environment focused on fun and safety.
