It is that time of year when hail will fall and your roof will be damaged. Get ready for something along the lines of the damage is superficial or the complained of problem is from wear and tear and not covered. These are just some of the responses I have seen to valid claims for damage from covered perils. Insurance carriers employ third-parties who do nothing other than travel around inspecting roofs and providing reports that allow the insurance carrier cover to say no to your claim. Insurance has gone through the roof. Despite record profits (look at Berkshire Hathaway latest disclosure) premiums are up, but riders on policies exclude “cosmetic damage” on commercial roofs and coinsurance riders that can require you to share in the cost to repair on replacement cost policies. Make sure you have enough coverage and if you have a metal roof, be Leary of cosmetic waivers.

Revisiting the infamous hot coffee case. Perception of this case is wrong. During the trial of the case, it was revealed that McDonald’s kept its coffee temperature between 180 and 190 degrees. liquids over 140 degrees can cause serious burns. McDonalds served its coffee this hot because they claimed it made the coffee taste better. Have you ever spilled coffee on yourself? Would you expect to need skin grafts if you did?
