Fellow Georgians, these oral arguments and forthcoming opinions are deserved of your attention. Medical providers (and their insurance companies) want to limit damages for wrongful death caused by medical malpractice to $350,000. I am obviously biased for victims of negligence and medical malpractice, but a jury of your peers should decide liability, causation, and damages (just like whether or not you’re guilty of a crime). Neither a judge nor legislature should be permitted to reduce or eliminate what a jury found. I hope Georgians keep this right. To take it away is downright unAmerican. We shouldn’t allow oligarchs (including multibillion dollar health care providers or their insurance companies) to remove rights through the purchase of a legislative branch.
At issue is a law the Georgia Supreme Court already overturned in 2010, which put a limit of $350,000 on jury awards in medical malpractice claims.
