We peace of mind to businesses and individuals in the areas of real estate, contracts and financial disputes. I love to demystify complicated real estate and financial legal concepts and problems for people who are frustrated, "spinning their wheels" with incompetent or dismissive real estate or banking "professionals." I hate when someone finds themselves at a legal disadvantage - they're "stuck"

when they unknowingly relying on outdated or impractical information and forms off of the "internet." It's unfortunate when someone bases their legal decisions off of "outside chatter." They rely on the opinion of someone they hardly know, (or worse, friends or family members) who is NOT a licensed and experienced real estate or finance attorney, and frankly, has no "skin in the game." For the above reasons, I actively write, publish and create books, articles, podcasts, slide presentations and newsletters -all designed to simplify complicated legal concepts related to real estate and finance. I strive to make these resources user -friendly and practical so that someone with a legal concern can understand how to reduce their legal liability and financial exposure in the real estate and debt arenas.

Question: "I have a question about property forfeiture. My landlord lost the home that I rented from her to foreclosure. Do I have to still pay the landlord?"

David's Answer: From your fact pattern, it sounds like you are saying she lost the property to 'tax foreclosure.’ If this is the case, she no longer has an interest in the property and can't evict. However, if the landlord still has her interest in the property (she may have been given the right to still redeem the property tax delinquency in Wayne County) then this will not negate your obligation to the landlord under the lease.

Question: "A distant family member became a caregiver to my sick father and moving into the home to provide care two months before his death. After he passed away, she filed a deed to his home naming her as the grantee. But in his earlier will he had left his home to me. This is so sudden. What can I do?"

David's Answer: If you suspect that your relative "overreached," then you have the right to challenge this late and surprising conveyance. There is a “rebuttable presumption” of undue influence when a “substantial beneficiary” of a proposed will had a “confidential relationship” with the decedent and used that relationship to “actively procure” the will or in this case, the deed. In simple terms, if someone abused their trust to manipulate your father into leaving them the bulk of their estate, a judge will assume there was undue influence unless this family member can prove otherwise. So, the only way to challenge your relative is to bring an action against them in court.
