Here, in a nutshell, is the problem with "estate planning" from the Elder Law point of view, it is about "death and taxes." It does not address the needs and preferences of elders as they age. Had to pay for a nursing home for rehab? Get your money back.
Over the years I had quite a few cases of clients going to the hospital then to the nursing home for Medicare paid rehab, only to find out that Medicare would not pay the nursing home fees. Appeal was fruitless so clients were stuck with bills that sometimes were in the thousands of dollars. Now the clients can get their money back from CMS!
Here’s the story. The Center for Medicare Advocacy, a patient advocate group, filed a lawsuit against CMS in a case called Alexander v. Azar. They won and the court ruled CMS should pay the nursing home costs. Patients who were hospitalized from January 1, 2009 to February 13, 2025 may now file an appeal with CMS to get their money back. You WILL NEED an attorney experienced in Medicare appeals or other experienced advocate.
Again: Please note CMS appeals are very complicated and technical. Again: If you or somebody you know is in this situation contact a lawyer who is experienced in Medicare appeals. You can also contact my office by phone at 248-356-3500 and we can send you the info on how to get info from CMS.
