ANUNCIO IMPORTANTE PARA PERSONAS CON ESTADO DE PROTECCION TEMPORAL (TPS) CON ORDENES DE REMOCION O DEPORTACION.
Como resultado de un cambio en la poliza de USCIS en Diciembre 2019 individuos con TPS fueron negados ajuste de estado si tenian una orden de deportación y habían viajado con permiso de viaje (Advance Parole). Como resultado de la resolución del caso de CARECEN et al v. Jaddou en la Corte de Distrito del Distrito de Columbia (1:20-cv-02363) usted puede ser elegible para reabrir su caso de deportación, desestimar su orden de deportación y ajustar a residencia permanente con Inmigración. Este cambio le aplica si usted:
a. Tiene Estado de Proteccion Temporal (TPS);
b. Tiene una orden de deportacion, remoción o exclusion por la Corte de Inmigración de EOIR o de Inmigración INS;
c. Ha viajado con advance parole (permiso de viaje); y
d. Es elegible para la residencia, porque por ejemplo tiene una peticion de familia aprobada o pendiente como miembro de familia immediata (o sea padres de ciudadanos o esposos de ciudadanos) , y ha sido inspeccionado y admitido o paroled llenando el requisito de la Seccion 245(a) de la Ley de Inmigración.

Usted tendrá hasta el mes de enero del 2025 para pedir la reapertura de su caso de deportación. Si su caso de residencia fue negado también podra pedir la reapertura de su residencia ante USCIS una vez se cancele su orden de deportación. Para mas información favor de llamar a la oficina.

IMPORTANT ANNOUNCEMENT REGARDING INDIVIDUALS WITH TEMPORARY PROTECTED STATUS AND ORDERS OF REMOVAL OR DEPORTATION.
As a result of a change of Policy by USCIS in December 2019 individuals with TPS were denied adjustment of status if they had a final order of removal and had traveled on advance parole. As a result of the settlement in the matter of CARECEN et al v Jaddou in the United States District Court for the District of Columbia (1:20-cv-02363) you may now be eligible to reopen and dismiss your deportation or removal proceedings and adjust status to permanent residence. This settlement affects you if you are a person who:
a. Currently possesses Temporary Protected Status;
b. Has a removal, deportation, or exclusion order issued by the Executive Office for Immigration Review or its predecessor agency, the U.S. Immigration and Naturalization Service;
c. Has traveled on advance parole since that order was issued; and
d. Is otherwise prima facie eligible to file an application for adjustment of status with USCIS, including but not limited to those with a pending or approved I-130 “immediate relative” visa petition who meet the “inspected and admitted or paroled” requirement of Section 245(a) of the Immigration and Nationality Act, and you are seeking to adjust under that provision.
You have until January 2025 to reopen your deportation cases and then file for adjustment with USCIS or have USCIS reopen a previously denied adjustment of status application. For more information please call our office for an appointment.

The office is open Monday through Friday from 9am to 6 pm. We are seeing clients with appointments in the following manners. We are offering appointments by Video Conference on Zoom, by WhatsApp, by telephone, or as a last option in person. For those who are already office clients we inform you that many of your questions or concerns about your case can be answered over the phone and we ask that you choose to make your appointments unless the attorney advises you that you must come in person. Similarly to provide us documents you can do so by email, by regular mail or by coming to the office and dropping them off in the boxes we have designated for this purpose. If you have to come to the office for your appointment we ask that you comply with the following:
INSTRUCTIONS TO ENTER MONTAGUT & SOBRAL:
Please do not come to the office if you have or have had symptoms of COVID19 such as a cough fever, difficulty breathing.
Please do not come to the office is you have been in close contact in the past 14 days with someone who has had or is suspected of having COVID-19
Please do not come to the office if you have been advised by a health professional in the past 14 days to quarantine yourself.
ANY SUCH PERSON MUST CANCEL THE APPOINTMENT AND RESCHEDULE

WHEN YOU ARRIVE AT THE OFFICE:
Please do not arrive more than 15 minutes before your appointment.
Please do not bring children to the office and no more than 2 persons per appointment
Please come inside, register, make your payment and if asked to do so return to the car until the attorney/paralegal is available to meet you. We cannot allow people waiting in the waiting room.
While in the office you must wear a face mask and it must be worn properly covering your nose and mouth at all times.
While you are in the office please maintain social distancing of 6 feet.
For your convenience all receptionists and individual desks have hand sanitizer.
