A direct inheritance — even a well-intentioned one — can disqualify a special needs child from Medicaid and SSI benefits they depend on. A lump sum from a beneficiary designation or a will can eliminate eligibility overnight.

A Special Needs Trust holds assets for your child's benefit without disqualifying them from public benefits. It requires intentional planning. A standard equal split doesn't do it.

Equal isn't always fair. A special needs plan makes sure your child is actually protected.

The clients who need estate plans most urgently are often the youngest ones — because they have minor children. If something happened to you today, who would raise your kids? Who would control the money left for them? Without a trust, a court decides both questions.

Transferring retirement accounts directly into a revocable trust is almost always the wrong move. It can trigger immediate income tax on the entire balance — treating it as a full distribution. Retirement accounts pass best through properly designated beneficiaries, coordinated with your overall plan.

The trust controls your estate. Beneficiary designations control your retirement accounts. Both matter. Neither replaces the other.
Retirement accounts and trusts work together — but they work differently. Know the difference.
