Juries never know how to sentence defendants who they find guilty. They can determine guilt or innocence alright, but enlightened sentencing of convicted defendants is not in their wheelhouse at all.

The question I am most frequently asked about bankruptcy is "What can I keep out of the case?" The answer is "Virtually nothing." The real question is "What will happen to my property and my debts if I file a bankruptcy petition?" The answers to that question are critical to making an informed decision about whether bankruptcy is right for you. A client is entitled to know the answers to questions such as "What will happen to my house and my car?" "Will my employer find out I filed?" "Can I keep my credit union account?" "Do I have to pay money to my creditors?"

Not surprising. People take longer to decide to file because they are often emotional, uninformed, and irrational. Businesses have lawyers and make business decisions based on the facts, law, and professional advice. People should look at their family's situation like a Board of Directors looks at the business's situation and act like a dispassionate Board would act.

Bankruptcies declared by businesses in the U.S. rose nearly 50 percent in May, as the economy continues to feel the sting of the coronavirus pandemic.

This is to confirm your appointment at our office address listed below and to alleviate as many of your concerns about the signing process as I can under the circumstances. First of all, let me assure you my staff and I are at least as concerned as you are about the pandemic. We are taking every precaution to protect you and ourselves while accomplishing your objective. Real estate closings have been deemed an essential function of the economy by the US Treasury Department.
First of all, the setting. My office is a small two-story townhouse. There is no elevator. No one is allowed into the building except people who must apply pen to paper to close a real estate transaction. Upon arrival, a person will direct you upstairs to a conference room to sign documents. We will have a paralegal or myself in the room virtually on a tablet to guide you through the process. You will have no other contact with staff members in our office. The area you will sign in will be disinfected before and after your appointment. New pens will be available to use and take with you. Each document will be highlighted where initials or signatures are required. There will be a folder for you to take with you and a copy of all signed documents will be sent to you via encrypted email.

Please send a copy of your photo ID by email, fax, or text to 703-598-3000 (my cell phone) prior to your closing.
If your transaction is a sale, please note we will not schedule buyers and sellers to sign at the same time and ask that only the necessary parties be present for signing. I define necessary parties as those who actually put pen to paper. All others can be reached by phone or other means from your cellular device.
All persons must wear protective face covering while in our building.
If you answer “YES” to one or more of the following questions, please call us to RESCHEDULE your appointment.

Good time to review your auto insurance policy and make sure you have adequate uninsured motorists coverage to protect yourself against all the drivers out there who have a $25,000 limit policy and no personal assets to speak of. The cycle of debt continues as I have observed in the past 36 years of practicing law. Every 15 years or so it seems a wave of bankruptcies are filed to discharge this debt which can never be repaid during the borrowers' lifetimes. A general rule is if it is good for the banks, it is not good for the consumers, hence the continuous tension between the two. A new bankruptcy chapter for small businesses goes into effect February 2020 - SubChapter 5. The new chapter is less costly than Chapter 11. It was designed to promote simplicity and efficiency for reorganization of small-business debtors. The new chapter may save some struggling small businesses from closing their doors because they couldn't afford Chapter 11.
