Answer: Under Virginia Code Ann. 46.2-817 – once a driver of a motor vehicle receives a visible or audible signal from a law enforcement officer to stop his or her vehicle – he or she must obey. To disregard may turn into a crime. One may be charged as a felony or a misdemeanor depending on the circumstances. You may also lose your privilege to drive not only by the court but also by the Department of Motor Vehicles.

Yes, Virginia Code Ann. 18.2-268.2 addresses Implied Consent to post arrest testing to determine alcohol or drug or both in one’s blood if you are suspected to be driving under the influence. An officer may charge that the suspect is deemed to have consented to a breadth or blood test after being arrested for a DUI or DWI.
