There are many different types of assault and battery laws in Virginia. In Virginia, an assault and battery charge is also referred to as an A&B. For example, a person in Virginia can be charged with simple assault and battery, domestic assault and battery (a.k.a. domestic violence or assault on a family member) or felony assault and battery on a police officer. Simply because someone is charged with an offense of assault and battery or domestic violence in Virginia does not mean that they are going to be convicted as charged. The assault or domestic violence charge could be dismissed if the facts are such that the Commonwealth attorney in Virginia decides that they will not prevail at trial or there are some compelling reasons as to why the Virginia Commonwealth attorney should not pursue prosecution of the charge. There are also different plea bargain options available to the client if certain facts are present and the Virginia assault and battery attorney handling the matter is skilled at negotiating a good plea bargain. As always, there is the option of going to trial and proving one’s innocence at trial. However, this option should be considered as a last resort as there are no guarantees as to the outcome of the case at trial, unless one has absolutely no other options available or one is certain as to the outcome of one’s case. Only the client can ultimately decide what is best for them self. “Eleven months, twenty-nine days, all suspended.” I heard that sentence imposed on occasion for misdemeanors during my legal education in Tennessee. Now, practicing law in Virginia, I hear on occasion a sentence of one year imposed by judges for similar crimes. The reason for the difference is simple. The maximum sentence for Class A misdemeanors in Tennessee is eleven years, twenty-nine days, while the maximum sentence for Class 1 misdemeanor in Virginia is one year. Therefore, if you were to steal two packs of gum—one from a gas station on the Virginia side of Bristol and the other from a gas station on the Tennessee side of Bristol—you could receive one more day in jail in VA than you could in Tennessee. If you are a citizen, this difference should not matter. If you are a non-citizen, however, then the difference could result in removal from the United States.

Warrantless Searches-Virginia: Just Say No

About three weeks ago the Supreme Court handed down a remarkable decision on the Second Amendment, in which the high court vacated a ruling by the Supreme Judicial Court of Massachusetts upholding that State’s ban on stun guns. The Massachusetts Court had held that stun guns are not protected by the 2nd Amendment first, because stun guns were not in common use at the time of the 2nd Amendment’s enactment; second, because it deemed stun guns to be “dangerous and unusual weapons” prohibited at common law; and third, because stun guns “are not readily adaptable to use in the military.” The Supreme Court rejected each of these findings in turn as being in conflict with its holdings in District of Columbia v. Heller, as applied to the States by MacDonald v. Chicago. This much is unsurprising. What is surprising, however, is that in rejecting the Massachusetts Court ruling, the Supreme Court did so by a vote of 8 – 0: meaning that the conservative wing of the court, that supported Heller and MacDonald, and also the liberal wing that was in opposition, voted to overturn the lower court’s ruling.

Cases which settle are generally less costly than cases that must be litigated in court.
