XLP helps custodial parent recover missing children

Jonathan Francis and the Personal and Individual Rights Litigation ( PIRL) team at XLP helped a custodial parent recover his missing children from a non-custodial parent who absconded from Virginia with the children. Jonathan secured a child custody order for our client, then worked with the court system and National Law enforcement agencies to locate the children after the non-custodial parent violated the court’s order to turn the children over to our client. The children were located, safe, and are back with their father, while the non-custodial parent is now in police custody.

Significant change is coming to Virginia civil litigation!

On July 1, 2021 Virginia’s jurisdictional limit for personal injury cases filed in General District Court will increase from $25,000 to $50,000. The General Assembly’s amendment to Virginia Code Sections 8.01-195.4, 16.1-77, and 16.1-107 will create the option for personal injury victims with damages between $25,000 and $50,000 to file their case in either General District Court or Circuit Court. It is crucial for personal injury victims to understand the implications of filing in each court, as there are several important procedural differences that can impact the outcome of a personal injury case. Plaintiffs will need to consider many factors before filing suit, including how quickly they want a trial, the type and extent of discovery that will be required, and whether demanding a jury trial will increase their likelihood of success. Experienced attorneys can help a personal injury victim consider all relevant factors when determining which court best suits their unique case and guide them to a decision that will set them up to recover the maximum amount possible.

The United States Court of Appeals for the Federal Circuit ruled in favor of an XLP client in a case argued by Partner and Managing Member Milt Johns. The Court of Appeals issued a precedential ruling that the XLP client, a U.S. government contracting company, did state a claim for additional costs as damages incurred as a result of a contract change by the U.S. Navy where no formal contract modification was issued by the contracting officer. The XLP Corporate Transactions team closed a Merger & Acquisition (M&A) deal for an XLP client that involved drafting the Letter of Intent, the Asset Purchase Agreement, performing due diligence, securing Intellectual Property (IP) rights, completing the closing, and executing funds transfers. The Asset Purchase secured important IP for the client, positioning them for growth. XLP professionals with significant real-world business experience performed detailed drafting, analysis and management for the transaction at a cost well below market averages. Jill Helwig and the XLP Litigation Team secured a significant settlement for an aviation client in a dispute with a vendor. An aircraft belonging to XLP’s client was damaged while undergoing maintenance at a vendor facility. When the vendor refused to take responsibility for the damages, XLP initiated arbitration proceedings on behalf of the client. After filing, but before arbitration, the vendor agreed to cover the costs of all of the damages to the aircraft, plus the filing and attorney fees incurred by XLP’s client.

Michelle represents and advises clients in a wide variety of government contracting and commercial litigation matters. She represents clients in bid protests at the Government Accountability Office and the Court of Federal Claims, size and status protests before the Small Business Administration, and appeals under the Contract Disputes Act at the Court of Federal Claims, Civilian Board of Contract Appeals, and Armed Services Board of Contract Appeals. Michelle has also represented clients in contract disputes in state court, federal court, and in arbitration.

Ms. Litteken is an active member of the ABA’s Public Contracts Law Section where she is the vice chair of the Bid Protest Committee and the Contract Claims & Disputes Resolution Committee. Prior to working with XLP, Ms. Litteken was Counsel at Piliero Mazza, she clerked at the U.S. Court of Federal Claims, and was an associate at two large, international law firms. Executive Law Partners, PLLC is pleased to announce that Andrew Knaggs has joined the firm as Counsel. Andrew has a diverse legal practice involving corporate law, mergers and acquisitions, government contracts, cyber security and other national security-related issues.
Andrew also has deep leadership experience. He commanded a team of Green Berets, deployed to Iraq twice, and was awarded the Bronze Star Medal for combat actions. He has also served as a federal civilian in multiple capacities, including as the Chief of Research and Engineering at the Joint Improvised Explosive Device Defeat Organization (JIEDDO) and most recently, for two years as Deputy Assistant Secretary of Defense for Special Operations and Combating Terrorism.

COVID-19 Economic Relief Bill moves from the Senate to the House

This week amid COVID-19 concerns, the Senate passed a bill to be sent to the House of Representatives for a vote on Thursday April 23, 2020 as the next installment of the economic recovery package. The bill, titled the Paycheck Protection Program and Health Care Enhancement Act (PPP/HCE), includes major additional funding for small business loans and grants to help ease economic losses. Additionally, the bill includes funding for hospitals and businesses to conduct COVID-19 testing.

Major sources of funding in the bill include:

1. $310 billion for the Small Business Administration’s (SBA) Paycheck Protection Program (PPP). This allows for the issuance of additional forgivable loans from the federal government to cover payroll and operating expenses for more small businesses after the previous fund ran dry.
2. $60 billion to the SBA’s economic injury disaster loans and grants.
a. Includes $50 billion for economic injury disaster loans, of which can be up to $2 million and a maximum interest rate of 4% with repayment periods of up to 30 years.
b. $10 billion allocated for grants of up to $10,000
c. The new bill allows for agricultural enterprises with no more than 500 employees to receive this funding as well.
3. $75 billion to support hospital workers and those in the healthcare system who have suffered due to the outbreak.
4. $25 billion has been allocated to expand testing.
a. This $25 billion includes $11 billion for states, and localities to purchase and administer COVID-19 tests.
b. This fund includes money for businesses to administer employer testing.
