New by Jessica Zemanski, Matthew Burnett, and Thomas Rutledge — Does Your Business Have a Living Will? Maybe (Probably) It Should

You're likely familiar with the basics of estate planning documents: wills, healthcare power of attorney, general power of attorney, trusts for your children and other survivors, and similar documents — but have you thought about those issues with respect to your business? In their coauthored article, our attorneys examine commonly overlooked risks, why a personal will isn't enough, and what your business living will should include to protect what you've built.

Last week, Timothy Eifler led a session at the University of Kentucky J. David Rosenberg College of Law's 2026 Bourbon (Distilled Spirits) Law CLE program.

His presentation, Kentucky State and Local Taxation of Alcoholic Beverages, examined the intricacies that lie beneath the surface of one of the Commonwealth's signature industries.

Great work, Tim!

“Institutions like Keeneland remind us that excellence is never accidental — it is built over generations through vision, stewardship, and a commitment to serving something larger than ourselves."

Today is a historic opening day for Keeneland Association, as the 2026 Fall Race Meet marks 90 years of racing at Keeneland Race Course. On this opening day, highlighted by the Phoenix, we honor the storied history and rich traditions that brought us here, and look forward to what lies ahead.

Did you know that one of the earliest and most influential equine syndication agreements was developed at what is now Stoll Keenon Ogden PLLC?

Gayle Mohney (1906-1980), a nationally recognized equine attorney and pioneer in Thoroughbred syndication, helped develop the innovative agreement that redefined ownership models and influenced equine syndication structures that remain standard today. He also worked directly with founder Richard C. Stoll to draft the articles of incorporation that created the [tag] Keeneland Association in 1935.

Mohney's legacy reflects the enduring relationships, shared values, and commitment to excellence that have connected our firm to Kentucky's equine industry for generations. Attorneys in our equine practice continue to advise owners, breeders, trainers, racetracks, and associations on the industry's complex legal matters.

Storied history, rich traditions, and “racing as it was meant to be” return this Friday with opening day of Keeneland's 2026 Fall Race Meet and the running of the $400,000 Stoll Keenon Ogden Phoenix Stakes (G2).

09/25/2026

We are one week away from KeenelandAssociation's 2026 Fall Race Meet!

Next Friday, the $400,000 Stoll Keenon Ogden Phoenix Stakes (G2) will once again highlight opening day at Keeneland. Beginning in 1831, the Phoenix is the oldest continuously run stakes race in the United States. The Phoenix Stakes is for three-year-olds and up going six furlongs on the main track. The winner receives a spot in the starting gate for the 2026 Breeders' Cup Sprint (G1).

We are proud to serve as the race’s sponsor, which is a reflection of our firm’s longstanding relationship with Keeneland and our continued commitment to Kentucky’s equine industry. For decades, our attorneys have advised clients across the industry, providing trusted counsel on legal and business matters.
