Jill" came to us confused. Her father was a smart man who had done his research. He created a Living Trust, signed it, and filed it away safely.

So why was she still facing months of probate court in Cook County?

Because his trust was never funded.

He had built the engine but never put in the fuel. Because his accounts and home were never retitled into the trust, the law treated them as if he had no trust at all.

This is the danger of DIY planning. It’s easy to find a form online. It’s much harder to know how to make that form work in the real world, under Illinois law.

We often meet smart, responsible people who tried to do everything right. They downloaded templates, filled out the forms, and put their trust in a nice binder.

But they missed the "invisible" work.

Think of a Living Trust like a bucket. If you buy the bucket but leave your assets sitting on the floor next to it, the bucket can’t carry them.

If your assets (like your Evanston home or your primary checking account) are still in your individual name when you pass away, they generally have to go through the court system to get to your heirs—even if your trust says otherwise.

The paperwork isn’t the finish line. Properly titling your assets is what makes the plan work.
