Kayla is an experienced family law attorney and will mainly be practicing family law, but will be pitching in to help with the firm's other areas of practice such as business litigation, personal injury, and criminal defense as well. We are excited to have Kayla join us and we know she will be an asset to our firm and to our clients.

Remember folks, June is a funny month for weekend counting.

This weekend, June 7 is actually the 1st weekend of the month because the 7th is the first Friday. Next weekend is Father’s day weekend.

So for dad’s that are Non-custodial parents with standard possession, you will have 4 weekends in a row:

5th weekend in May
1st weekend in June (June7-9)
Father’s day weekend (June 14-16), and
3rd weekend in June (June 21-23)

🌬 How cold is it in the upper Midwest? Crews in Chicago are *literally* having to set train tracks on fire. Why? When it gets too cold, the switches that direct the cars between tracks can freeze. If a switch fails, an entire railroad line could be compromised.

Farewell lunch for our associate attorney Aulstin Gardiner. He is moving to the dark side and going to work for the District Attorney’s Office where he will represent CPS. A loss for us and gain for the DA. We will continue see him regularly, but we will be on opposite side of cases.

Yesterday we settled a lawsuit that we filed for a veteran. We took the case pro bono (free). It was against a local car dealership that had wronged our client. We initially wrote a letter that went ignored. Only after filing the lawsuit did the dealership step up and make it right by our client. They initially positioned themselves to defend the lawsuit vigorously. But, after the attorney for the dealership found out from us that our client was a veteran, their attitude changed and they did the right thing. They deserve some credit for that.

"...we can't keep bending the Fourth Amendment to the resources of law enforcement. Particularly when this stop is not—is not incidental to the purpose of the stop. It's purely to help the police get more criminals, yes. But then the Fourth Amendment becomes a useless piece of paper." -- Justice Sotomayor. Is she correct?

We hope everyone enjoyed their holidays, and are looking forward to the new year. Please be careful as you celebrate, and remember to arrange for transportation if you plan to enjoy some beverages around the new year. But if you ignore that better advice, then remember to not blow and do not consent to a taking of your blood by anyone, do not consent to a search of your vehicle, do not agree to do any of the field sobriety tests regardless how guilty the officer may try to make you feel, be polite and courteous to the police officer, and put Brandon's cell phone number in your phone ahead of time.

Case Detail

Good news for the Fourth Amendment. From the Texas Court of Criminal Appeals today, State v. Villarreal. "We hold that a nonconsensual search of a DWI suspect’s blood conducted pursuant to the mandatory-blood-draw and implied-consent provisions in the Transportation Code, when undertaken in the absence of a warrant or any applicable exception to the warrant requirement, violates the
Fourth Amendment."
