Personal Injury FAQ: What steps should I take after a car accident?
1. Stay at the Scene-Never leave the accident scene until all parties exchanged information (See number 4.) and/or the police have concluded their investigation/interviews of all parties.
2. Call 911-If there's significant property damage, physical injury, or death, please call 911 immediately.
3. Never admit fault-This can be used against you later. Use caution in discussing the incident, including with the police and paramedics.
4. Exchange Information-Get the names, numbers, addresses, drivers' license numbers, license plate numbers and basic insurance information from all drivers involved.
5. Take pictures-Take photographs/videos of the scene of the accident, street signs in the area, the license plates of vehicles, the property damage of all vehicles and the locations of all vehicles at the scene of the accident, preferably before the vehicles are moved from the final resting spot right after the accident.
6. Locate Witnesses-Independent witnesses can make or break your case! Ask every witness what they saw. If possible, get their contact information. If there are businesses or residents nearby, find out if they have video cameras pointed toward the location of the accident.
7. Seek medical care immediately-Sometimes injuries from accidents are not evident right away. It is crucial to seek medical treatment and evaluations following an accident. Moreover, there may be body parts that hurt more than others; however, it is vital that you mention ALL body parts that hurt to the medical providers, and not just the ones that hurt the most. Many times, those body parts that hurt less in the beginning end up being the biggest issue later on. Insurance companies and defense counsel always focus on the fact that that body part was not mentioned in the beginning, therefore, will not consider it part of the case.
