exemption โ€” from rent caps and just cause requirements.

But the exemption requires a specific written notice to the
tenant. Without it, a court may find the exemption waived.

The property qualifies. The notice was never served.

That's a problem you find out about at the worst possible

without a court order.

Civil Code ยง789.3 prohibits it. Always.

The penalty: $100 per day from the first day of the violation.
Before hotel costs. Before attorney's fees. Before anything else.

The only legal path is the formal eviction process.

Most landlords expect that winning in court means the eviction is almost over.

Here's what actually happens next.

The Writ of Possession goes to the Alameda County Sheriff's Civil Division.
And then you wait.

In our experience, it typically takes 2โ€“4 weeks from writ delivery before the Sheriff even posts the 5-day notice on the property.

That's not a delay. That's the standard queue.

After posting โ€” five more days for the tenant to vacate voluntarily.
Then the Sheriff returns to execute.

Total time from writ to possession: 3โ€“5 weeks.
After you've already won.

The court moves in days. The Sheriff moves in weeks.
