Harvesting Your Legacy: Revisiting
and Updating Your Estate Plan This Fall

As autumn paints the world in colorful hues, farmers across the country are busy preparing for the harvest. This season offers a perfect metaphor for a crucial aspect of personal finance: updating your estate plan. Just as farmers meticulously plan for a successful harvest, individuals should take this time to ensure their estate plans adequately reflect their current wishes and circumstances.

The fall season is a natural time for reflection and preparation. Just as crops are carefully inspected and fields are tended to, your estate plan deserves a thorough review. Life changes, such as a new family member, a significant shift in financial status, or even changes in relationships, can all impact the efficacy of your estate plan. If you haven’t revisited your plan recently, now is the ideal moment to ensure it still aligns with your current goals and circumstances.

Much like farmers evaluate their crops for ripeness, assess whether your estate plan is “harvest-ready.” Begin by reviewing your will and any trusts you have in place. Ensure that these documents accurately reflect your wishes and that they incorporate any recent changes in your life. For instance, if you've welcomed a grandchild or experienced a significant financial change, it’s essential to update your plan accordingly.

It is also a great time to review your beneficiary designations. You should review and confirm that the beneficiaries named in your estate plan and on accounts like retirement funds and insurance policies are still accurate. Life events such as marriage, divorce, or the death of a beneficiary can necessitate updates to ensure that your assets are distributed according to your wishes. If your first or second beneficiary in your designation list predeceases you, and there are no other alternates, this will necessitate a Probate. To avoid a Probate, you can designate your trust as the last beneficiary. Then if all beneficiaries have predeceased you, the trust will be the beneficiary, and prevent the need for a Probate.

Your estate plan should also reflect any changes in your financial landscape. If you’ve accumulated new assets, such as property, inheritance or investments, or if your financial situation has improved or worsened, it’s vital to address these changes in your plan. By doing so, you ensure that your assets are managed and distributed as you intend, optimizing the benefits for your heirs.

Just as farmers consult almanacs and weather patterns to prepare for the harvest, consider consulting with an estate planning professional to guide you through the process. They can offer insights into how recent legal changes may affect your plan and help you navigate complex decisions.

Cruising Into Retirement:
An Alternative to Nursing Home Care
With skilled nursing home care prices rising year after year, many retirees are looking into other avenues for their end-of-life care. Some are building additions onto their homes for whatever full-time care they may receive in-home in the future, and some are building tiny accessible homes on their children’s property. If the construction projects aren’t for you, some retirees are hitting the seas.

Mama Lee Wachtstetter began living on a cruise ship in 2008, and remained there into her 90s, more than 12 years later. It cost her approximately $164,000 per year for her single-occupancy room. That sounds expensive but even an “all-inclusive” assisted living facility would not have provided the same quality of goods and services. Mama Lee enjoyed daily lunch and dinner with beverages, tips, daily ballroom dancing, cocktail parties, movies, lectures, other shows, and entertainment and most uniquely: the opportunity to travel and meet people from all over the world. She said the one thing she missed was her family, but she stayed in touch with them via laptop and telephone and was able to see them about five times per year when she docked in Miami.

Others have followed in her footsteps. An Australian couple booked 51 back-to-back cruises, culminating in a 455 day trip…and they have no plans to stop anytime soon. They realized living on a cruise ship is cheaper than traditional retirement care. They are among a growing group of seniors who are spending their money being catered to on a cruise ship, for less than the cost of a nursing home.

While those requiring higher levels of skilled care will not be able to reside on a cruise ship, it may be an option for some. If you are fortunate enough to afford the bill of a cruise ship, why not see the world while having unlimited entertainment at your fingertips? Would you consider retiring on a cruise ship, at least for a couple years?

THE ALTERNATIVE TO PROBATE

Many people believe that if they have a valid Last Will and Testament (“Will”) when they pass away, their spouse, or their heirs, will be able to access their assets without the assistance of the Probate Court. In Kentucky, and all other states, a Last Will and Testament is probated to remove the deceased person's name off his or her assets so they may be transferred to the rightful heirs.

American Association of Retired Persons (“AARP”) published a two-year study on probate titled “A Report on Probate: Consumer Perspectives and Concerns.”

The study revealed that national probate costs were as much as $2 billion each year, with attorneys’ fees representing as much as 10%. This study claimed that the probate process inflicts undue strain, and emotional and financial duress on the unsuspecting public, who do not know they have alternatives to probate. AARP’s edict sums up the reason for lack of consumer knowledge: It’s a matter of money, and lots of it. The AARP study noted that attorneys often build lucrative practices focused solely on probate.

Alternatively, the “Living Trust” is a way to hold legal title to your assets without the need for probate. A surviving spouse retains full control of all assets funded into the Trust on the first spouse’s death, and then transfer to heirs is accomplished without probate. A Living Trust avoids unnecessary costs, frustrations, time delays, and family disputes that often accompany the probate process.
