MARYLAND HOMEOWNERS, DID YOU KNOW?

Maryland has a new estate-planning option that could make passing your home on to loved ones a little simpler!

As of October 1, 2026, homeowners can use a Transfer on Death (TOD) deed to name who will receive their home when they pass away—without the home having to go through probate. 🙌🏽

And here's the good news: while you're alive, YOU remain in control! You can still sell your home, refinance, or change your mind. Your heirs don't get a vote while you're living.

But before you get too excited, here are TWO IMPORTANT THINGS TO KNOW:

📌 1. It MUST be recorded.
The deed must be properly recorded with the appropriate county land records office before your death. Signing it and putting it in a drawer doesn't count!

📌 2. The mortgage comes with the house.
If there's still a mortgage on the property, your heirs may inherit the home with that debt attached. Federal law generally provides protections that may allow certain relatives who inherit a home to keep the existing mortgage without immediate repayment solely because of the transfer. However, the details matter, so get professional guidance.

💡 The bottom line: A Transfer on Death deed may be a useful tool for protecting your legacy, but it isn't a one-size-fits-all solution. Make sure the deed is prepared and recorded correctly, and understand how it fits into your overall estate plan.
