Seems like yesterday I won an appeal. Earlier today, I won yet ANOTHER appeal! This time, I got the DUI conviction of my client overturned on appeal due to the insufficiency of the evidence. She was wrongfully convicted. I appreciate the Fourth Judicial District Court for doing justice and reversing the injustice that was committed in the Elko Justice Court. (Fourth Judicial District Court Case Number DC-AP-22-1616).

On October 3, 2022, the Ben Gaumond Law Firm, PLLC got its latest win in the Nevada Supreme Court in Martin v. State, Nevada Supreme Court Case Number 83665. Shanell Martin's conviction for Possession of a Controlled Substance was overturned on appeal. The Nevada Supreme Court ruled that the district court judge lacked the discretion to adjudicate Ms. Martin as a felon and to send Ms. Martin to prison.

Yes. The Ben Gaumond Law Firm won another appeal. The case is Cooke vs. Daniels, Director, Nevada Department of Corrections. Nevada Court of Appeals Case # 83578-COA. Mr. Cooke demanded an appeal and his trial attorney did not appeal. We are entitled to an evidentiary hearing that was improperly denied.

On March 31, 2022, barely 1 year in existence, the Ben Gaumond Law Firm won its first appeal. The Justice of the Peace erred when His Honor shifted the burden of proof upon our client in a Battery prosecution. Case # CR-AP-19-9386 in the Fourth Judicial District Court.
