Do you need a lawyer if you’re using mediation?

Not necessarily. But understanding the difference between mediation and legal representation is important.

In mediation, the mediator remains neutral and helps both spouses work through decisions and reach agreements. They do not represent either person.

You can also choose to have your own attorney review the final agreement before signing. While not required, this can provide added peace of mind and help you understand your rights.

Every situation is different. If you’re considering mediation, learning about your options is a good place to start.

Sometimes, it means recognizing that a marriage is no longer working and choosing to move forward with intention.

Divorce can bring grief and uncertainty, but it can also be the beginning of a healthier, more peaceful chapter.

What matters is not just how you end a marriage, but how you move forward.

If you’re considering divorce, you don’t have to navigate the process alone. There are different ways to approach it, including collaborative divorce and mediation.

Divorce takes things.

The home you built together. The future you planned. The version of your life you thought you were going to have.

But here is what it also gives back.

Your voice. Your peace. Your time. Your future.

Yourself. The version of you that existed before you started making yourself smaller just to keep things calm.

Divorce is not only a loss. For many people, it is the beginning of the most honest relationship they have ever had. The one with themselves.

We are here whenever you are ready. 💙

Fun fact: You can get divorced in California without ever going to court in person.

When both spouses agree on the terms, many California counties process the divorce entirely through paperwork. No courtroom, no hearing, just the right forms filed correctly.

It's one more reason mediation and open communication go a long way. The more you and your spouse can agree on early, the smoother (and less stressful) the process tends to be.

Curious if this could apply to your situation? Send us a message, we're happy to answer questions.

Here's a quick breakdown of our services.

We guide clients through family law matters with a plan built around their specific needs. For those who want to stay out of court, we offer mediation, a structured process that helps both sides reach an agreement together. We also support collaborative divorce, a cooperative alternative to traditional litigation that keeps things respectful and private.

And every step of the way, we prepare and review your legal paperwork carefully, so nothing gets filed late or wrong.

Divorce is stressful enough without believing things that aren't even true. Here are 5 things people often get wrong, and what's actually true under California law:

1️⃣ Myth: You have to go to court to get divorced.
Truth: Most California divorces settle without ever stepping into a courtroom.

2️⃣ Myth: The judge automatically splits everything 50/50.
Truth: California follows community property rules, but "equal" doesn't always mean "identical."

3️⃣ Myth: Choosing mediation means you're giving up or being weak.
Truth: Mediation puts you in control of the outcome instead of leaving it to a judge.

4️⃣ Myth: Mom always gets custody.
Truth: California courts decide custody based on the best interests of the child, not the parent's gender.

5️⃣ Myth: You need a lawyer for every part of the process.
Truth: Having guidance helps you avoid costly mistakes, especially with complex assets or custody.

Save this for later or share it with someone who needs it.

When people think of collaborative divorce, they often focus on the adults. But if kids are part of the picture, their well-being shapes everything about how the process should go.

Collaborative divorce gives parents the space to make decisions together, away from a courtroom, with the child's stability and routine kept front and center. It's not always easy, but it can mean fewer disruptions and less conflict for the kids caught in the middle.

If you're navigating a divorce and want an approach that puts your children first, reach out today. Visit shearerlawandmediation.com to schedule a consultation.
