Probate Case Study-Venue

Mary (not real name) owned a home in Stockton, California (San Joaquin County) but was living in a rented apartment in Elk Grove, California (Sacramento County) at the time of her death.

If probate is required, which is the correct county?

California Probate Code ยง7051 provides: "If the decedent was domiciled in this state at the time of death, the proper county for proceedings concerning administration of the decedent's estate is the county in which the decedent was domiciled, regardless of where the decedent died."

Based on the above facts, the proper county for the probate proceedings is Sacramento County.

I passed! My skills and competence as an estate planning attorney were put to the test today and I am happy to report I passed with flying colors.

Your estate planning is too important to trust to anyone other than a licensed member of the State Bar where you live who regularly practices estate planning and regularly participates in continuing legal education courses.

If you are acting as the personal representative for someone, whether it be as their executor, administrator, successor trustee or conservator, remember to complete and file a change of address with the post office.

When the post office realizes a home is vacant, they will stop delivering mail, so there may be notices and bills you were not receiving.

Be prepared to provide evidence to the post office you have the authority to request the change of address. This can be done through a court order or certification of trust
