No.

The officer has to observe you for a full 20 minutes before taking your first breath sample. If that doesn't happen, the breath test result can be kept out at trial.

The case can still go forward on the officer's observations.

New Jersey has the lowest drunk-driving death rate in the country, according to NHTSA data reported by the Asbury Park Press.

2 separate claims come out of a single death in New Jersey.

They get treated as one thing constantly, and they are not.

The wrongful death claim belongs to the dependents and covers what the family lost going forward. The survival action belongs to the estate and covers what the person went through before they died.

Different beneficiaries, different damages, different proof. Bringing one does not carry the other along with it.
