⚠️ DWC Clarifies Mandatory RFA Requirements

The Division of Workers’ Compensation has issued important guidance clarifying that the DWC RFA form is mandatory under California’s updated utilization review regulations that took effect April 1, 2026.

In a new Special Report, MS&A attorney Sure S. Log examines the DWC’s latest guidance, including when a narrative report may qualify as a functional equivalent, the five-business-day obligations imposed on claims administrators, and the compliance risks associated with incomplete RFAs.

In a recent WCAB panel decision, Garcia v. J M Eagle, the Board clarified that geographic inconvenience alone is not enough to justify replacing a QME. Instead, the analysis must consider whether the evidentiary record — including medical evidence regarding the applicant’s ability to travel — supports replacement.
