đź“Ł New Special Report on the MS&A Blog!

The California Supreme Court has issued an important decision affecting petitions for reconsideration and the WCAB’s 60-day deadline to act.

In a new Special Report, MS&A attorney Sure S. Log examines the Court’s decision in Mayor v. WCAB, which ends the WCAB’s practice of equitably tolling its own deadline under Labor Code § 5909. The decision also clarifies what happens when the 60-day period expires, including the resulting 45-day deadline for seeking writ review.

The ruling has important implications for practitioners on both sides of a reconsideration petition, who must carefully monitor these deadlines and understand the potential remedies when the WCAB issues a late decision.

📢 California's cumulative trauma claims are on a different scale than the rest of the country — and the gap is growing.

According to WCIRB's 2026 State of the System report, cumulative trauma (CT) claims make up 22% of indemnity claims in California. Every other NCCI state stays below 6%. This isn't a static gap, either. CT claim frequency in California has increased significantly since 2021, pulling the state further away from national norms.

For employers, carriers, and claims professionals operating in California, this trend is worth watching closely. It has real implications for reserving, litigation exposure, and claims handling strategy. When does California have jurisdiction over a workers’ compensation claim filed by an employee who works entirely from another state?

In a new article on the MS&A Blog, attorney Sure S. Log examines the recent WCAB panel decision in Danzey v. Aravo Solutions, Inc., which addresses jurisdiction over an out-of-state remote worker employed by a California-incorporated company. The decision provides important guidance on whether a choice-of-law provision can establish jurisdiction, whether jurisdiction can be waived through litigation conduct, and how Atlanta Falcons v. WCAB (Gandy) may apply to remote workers outside the professional sports context.
