We were able to obtain DUI dismissals for two clients in Macoupin County.

We also obtained a suspension rescission for another client in Macoupin County last week.

We were prepping for a first degree murder trial set to begin June 8, 2026. The state has now offered a second degree murder plea. This will be an important decision my client must now make as second degree has far less sentencing implications than first degree. We do have a strong self-defense theory to the case.

The state dismissed a felony aggravated domestic battery against my client yesterday. We were set on final pretrial in St. Clair w judge Haida. Trial was scheduled to begin January 5. We had all our subpoenas out a month prior and had all our pretrial motions/notices fon file. The state dismissed the case due to one witness not cooperating. That happens in domestic battery cases frequently. But they knew this half a year ago. My client has been in prison on a parole violation because of this charge. He had a public defender until October. I immediately announced ready for trial. The PD did nothing for my client.
On another note I got another client released from the El Paso, TX jail after a warrant hearing. The case is very old. His previous attorney was disbarred and a warrant was issued for failure to appear. The charge is drug trafficking, the state objected at the hearing. But the court ruled in my client’s favor.

I was able to get an Obstruction charge dismissed in St. Clair. My client had his door to the residence forced open by an officer from Shiloh. The officer did not have an arrest or search warrant. I filled a motion to suppress. The state was not prepared to argue the motion and the case was dismissed with their agreement. I am positive we would have won the motion had it proceeded to hearing.
I announced ready for trial in St. Clair county Friday. The trial is set 1/5/26. The state may not have a witness against my client as she is not willing to testify and desires the charges be dropped The state was not prepared and prepped/printed motions in limine in court and handed me a copy. Not sure why they are pursuing this case but it's their call. My client is currently in prison as his parole was revoked based upon this case.

Finished jury trial 147. Hannah co-chaired it. She conducted void dire, opening statement and direct of our client. It was her first jury trial. We won the two felony counts but lost the misdemeanor charge.

Hannah is now sworn in and practicing. I have her working on motions/responses and attending court settings. She has conducted similar settings last year when she worked with the public defender's office. We have our first trial set 12/2/2025 which we will try jointly. We have another in January and one in February. I'm sure we will have more set between now and then.

I was able to obtain probation (second chance) for a California resident who was caught with 200 pounds of cannabis on I-270. I had prepared and filed a motion to suppress evidence. A few days before the hearing the state contacted me and asked what they could offer to get the matter resolved without a hearing. I requested second chance probation. That probation does not result in judgment or a conviction against my client. At the end of the probation terms the case is fully dismissed.

The last two weeks I was able to get another felony agg. domestic battery dismissed, two DUI suspensions tossed out and a DUI reduced to Reckless.

Announced ready for trial on an Unlawful Possession of a controlled substance charge. the state instantly moved for dismissal of their charge. They did not want to disclose their confidential informant. We already knew who the person was. But if the state called that person at trial they would need to disclose the entire informant packet on the CI.
Obtained a reduced charge for a client facing methamphetamine delivery charges in Montgomery County. The state agreed to reduce his charge and allowed a sentence of TASC probation. My client will have no conviction upon successful completion of probation.
Filed a lawsuit against a law firm for a client in a bankruptcy matter. The firm had billed him over $40,000 and missed a deadline to file an objection to a person seeking bankruptcy. The firm is very large and is located in St. Louis. They had three different attorneys on the case and all of them missed the deadline. My client suffered about $600,000 in damages from their negligence.

Negotiated a DUI suspension rescission and future dismissal of the DUI charge for a client in Macoupin Co. yesterday. Also resolved a felony Domestic Battery to a misdemeanor Domestic charge for another client in the same county. Obtained a reduced Retail Theft charge from a felony version in Madison on Monday. Am working on the motion for relief and then the appeal for a client who was detained after a large amount of co***ne was found in his house. Was able to reduce two DUI charges last week in Madison County.

03/27/2025

Today I was able to negotiate two DUI suspension rescissions and a dismissal of a third DUI client's charge. The rescissions were based upon a failure to provide discovery to me in a timely fashion and a failure to fill out the Notice of Suspension form correctly. The agencies involved were Alton and Highland PDs. Both of my clients will not have to drive with a permit and will not be required to pay the reinstatement fee of $250.00.

The third client got his DUI dismissed in exchange for his plea to a misdemeanor cannabis case. He was a second offender so it was very important to obtain a dismissal of the charge.

I am meeting with a new client where the state is attempting to forfeit his residence for three controlled buys of co***ne out of the house. The drug sales were very small ($80 x 2 and one $100). His house is paid for an valued at $500,000. We will present an Eighth Amendment challenge to the forfeiture.

Obtained two domestic violence charge dismissals, a felony agg. fleeing dismissal and won a DUI at hearing the last week. We are currently gearing up for jury trials in May and June. Currently have two set each month. I did have another set for May but it the state agreed to offer probation on a reduced charge so that case will be resolved in the next week without the need for a trial.
