The Missouri–Illinois line runs straight through this market.

People live in Edwardsville and work in Clayton. They live in Chesterfield and drive to a job site in Madison County. Every day, thousands of drivers cross a state line where the DWI license rules are structurally different.

Get arrested on one side of the river with a license from the other side, and you have two systems in motion from one traffic stop.

The arresting state acts on your privilege to drive there.

Your home state gets the report — Missouri and Illinois both participate in the Driver License Compact — and can act on the license itself.

Two agencies. Two sets of paperwork. Two clocks that do not coordinate with each other and will not wait for each other.

A lawyer licensed in one of those states can handle one half of that problem.

I am licensed in both. That is not a marketing line. In this market, it is the whole job.

Everything I have said this week about Missouri and Illinois applies to you.

And then there is a third case on top of it.

Federal regulation disqualifies a commercial driver for one year after a first major offense — and it does not care that you were off duty, off the clock, in your own personal vehicle, on a Saturday.

The commercial standard is .04 in a commercial vehicle. Half of what applies to everyone else.

A refusal carries the same disqualification as a conviction.

A second major offense is a lifetime disqualification.

And here is the one that ends careers: the restricted driving privileges and permits that exist to keep people working — Missouri's restricted driving privilege, an Illinois MDDP — do not restore the commercial license. There is no hardship version of a CDL disqualification.

So a professional driver has a criminal case, a state license case with its own clock, and a federal commercial disqualification running underneath both of them.

If you drive for a living, the analysis on day one is not the same analysis as everybody else's. It cannot be.

If you hold a CDL, there's a third clock.

Federal regulation disqualifies a commercial driver for one year after a first major offense — off duty, personal vehicle, doesn't matter. The standard is .04 in a commercial vehicle. A refusal counts the same as a conviction.

And no restricted permit or MDDP restores a commercial license.

Illinois works the opposite way from Missouri, and the difference matters.

Missouri gives you fifteen days to ask for a hearing.

Illinois gives you forty-six days before the suspension happens to you.

Those are not the same thing.

In Illinois — Madison County, St. Clair County, anywhere in the state — the statutory summary suspension takes effect on the 46th day after the notice is served. It is automatic. Nobody has to do anything for it to arrive.

Your move is a petition to rescind, filed in the circuit court within ninety days of the notice. The court must hold the hearing within thirty days after it gets the request, or after your first appearance date on the ticket.

And the statute is blunt about one thing people always assume backward: filing does not stay the suspension. Day 46 arrives on schedule either way.

Do that math.

The forty-six days are not a cushion. They are the entire runway — to file, to be heard, and to get a ruling before the suspension shows up on its own.

Treating day 46 as the deadline instead of the destination is the most common mistake I see in Illinois cases.

If your notice is from Illinois, the countdown is already running. IL (618) 656-6622

Illinois doesn't give you 46 days to act — it gives you 46 days before the statutory summary suspension acts on you. The petition to rescind has to be filed and heard inside that window, and filing it does not stay the suspension. Day 46 is the destination, not the deadline. IL (618) 656-6622 · MO (314) 703-7602

In Missouri, the officer handed you the deadline and did not explain it.

It is called a Notice of Suspension or Revocation of Driving Privilege. Form 2385. It is in the stack of paper you got back.

That form is doing two things at the same time.

Where the officer marks it that way and your license was otherwise valid, it is your temporary permit to drive — for fifteen days.

And it starts a fifteen-day clock to request an administrative hearing with the Department of Revenue.

The form says it in its own words: if you do not timely request a hearing, your driving privilege is suspended or revoked fifteen days from the date of that notice, and you have no further appeal rights.

Now here is the part almost nobody knows.

A second filing shares that same fifteen days. A first alcohol contact in Missouri normally means ninety days — thirty of them with no driving at all, then sixty on a narrow restricted privilege. The alternative is ninety days of restricted driving with an ignition interlock and no thirty-day blackout, covering far more of ordinary life. That option has to be requested within fifteen days of the notice.

Two rights. One deadline. Both gone on day sixteen.

Read the date on the notice. Not the date of the arrest.

Missouri Form 2385 can be your temporary permit AND it starts your 15-day deadline — and a second filing shares that same window. Two rights, one deadline, both gone on day sixteen. Read the date on the notice, not the date of the arrest. MO (314) 703-7602 · IL (618) 656-6622

A DWI arrest does not create one case. It creates two.

There is a criminal case. It moves through the courts, on the timeline courts keep, and it usually has not even been filed yet.

And there is a driver's license case. It is administrative, it is separate, and it started the night of the arrest.

Different decision-makers. Different rules. Different deadlines.

Here is what that costs people: the case that moves slowest is not the case that dies first.

The court date on the summons might be six weeks out. The license deadline might be fifteen days out.

Most people spend those fifteen days worrying about the court date.

TWO CASES. TWO CLOCKS.

The strategy has to see both.
