In accordance with FMCSA regulations, annual queries for all DOT-regulated drivers must be performed at least once every 12 months within the Drug and Alcohol Clearinghouse. The timing of these queries is flexible, allowing the first annual query to be conducted at any time. However, subsequent queries must be conducted within 12 months of the initial query. For example, if the first query is conducted on November 1, the next query must be conducted by November 1 of the following year. Who is subject to these queries? All CDL drivers employed by a motor carrier employer are subject to annual queries, including the employer themselves if they are an owner-operator. What constitutes a query? A query is an electronic check that determines if a driver is prohibited from performing safety-sensitive functions due to unresolved drug and alcohol program violations. What are the consequences of failing to query? Failure to conduct the required queries could result in fines of up to $5,833 per driver.
