Most parents have had a conversation. Some have even reached a clear agreement. But an agreement that lives in your heads, and nowhere in a legal document, may carry no weight when it matters most.

If something happens to both parents, the people you trust most don’t automatically have legal authority to take custody. Grandparents, siblings, close friends, neighbors, even babysitter; love and good intentions don’t create legal authority.

This is the question we hear all the time: “We talked about it, does that count?”

Talking is a great first step. But real protection comes from putting the right plan in place so your children are cared for by the people you choose, without unnecessary court involvement.

August is Make A Will Month, and if you have been meaning to finally get a will done, good. Do it.

But here is what most people do not know. Getting a will done and getting your family protected are not the same thing.

A will does not avoid probate. It does not protect your family if you become incapacitated. It does not override outdated beneficiary designations. And if you have minor children, it does not address who has legal authority with your kids in the first 72 hours after something happens to you.

Most families discover these gaps at the worst possible moment.

Did you know? In many cases, divorce does not automatically update your estate planning documents.

A divorce decree addresses the marriage while you’re alive. Your Trust or Will and beneficiary designations control what happens after you die. Those are separate and if you don’t update your plan, your documents may still reflect a life that no longer exists.

This is one of the most common gaps we find when someone hasn’t reviewed their plan since a divorce.

What happens to your estate if you die without a will?

The state doesn’t make a decision based on your relationships or your intentions; it applies to a preset formula. Every state has default rules, called intestate succession laws, that determine who inherits, in what order, and in what percentage. Those rules don’t account for who you trusted, who you wanted to provide for, or what you would have wanted for the people you love.



That disconnect is what turned Tony Hsieh’s estate into a public, years-long process. Hsieh founded Zappos, sold it to Amazon for $1.2 billion, and wrote Delivering Happiness. He died at 46 with hundreds of millions of dollars, and no will or trust, so his estate went through public probate, where claims, disputes, and asset details can become part of the court record.



A relationship-based planning approach starts long before a crisis: not just signing documents, but making sure your plan is funded, kept current, and that your family has someone to call when something happens.
