FOURTH OF JULY NO REFUSAL WEEKEND: know your rights!

The Rio Grande Valley District Attorney's Coalition is now implementing the Fourth of July No Refusal Weekend. You are going to be made to believe that you cannot refuse any questions or tests … but that is FALSE.

All this means is that if you refuse, they will get a warrant to draw your blood. Therefore, what should you do?

Properly ID yourself, but do not answer any further questions.
Do not admit to drinking ANY beverages whatsoever.
Do not submit to any field sobriety tests.
Do not consent to any breath or blood tests. Make them get a warrant … and they will.

They will most likely arrest you for DWI, but they will do so with far less evidence and admissions than had you submitted to any of the above criteria. If you have any questions, contact your attorney.

Please do not drink and drive. If you do drink, get a ride or call a rideShare. If you get arrested, contact an experienced attorney.

Hey Sonny … can I get in trouble if my kid skips class or school?
Short answer .. yes.

But why?
Because kids not showing up to class or school is bad! School Districts can file a criminal negligence complaint against the parent or guardian. By the time a School District files this complaint, they have logs of attendance, call logs to the parents notifying them of the student’s absence, documentation showing the School District’s willingness and attempts to help the student back into school and resume classes.

What is Criminal Negligence when it comes to truancy?
Criminal negligence means that the parent or guardian “ought to be aware of a substantial and unjustifiable risk that the circumstances exist or the result will occur. The risk must be of such a nature and degree that the failure to perceive it constitutes a gross deviation from the standard of care that an ordinary person would exercise under all the circumstances as viewed from the actor's standpoint.” Penal Code § 6.03.

Ummmm…. What does that mean?
The School District is complaining that you have done som**hing that a reasonable parent would not have done by allowing your kid to skip class or school. The School District can also be complaining that you failed to do som**hing that a reasonable parent would have done by not sending or forcing your kid to attending class or school. You’re the parent, they’re the kid.

But I’m the cool parent … can I be punished for this? Yes.
• $100 for a first offense;
• $200 for a second offense;
• $300 for a third offense;
• $400 for a fourth offense; or
• $500 for a fifth or subsequent offense.
Education Code § 25.093(c).

Texas DPS is moving away from arresting people for low-level ma*****na offenses. As of July 10, all Texas DPS officers have been instructed to issue a citation for people with a misdemeanor amount of the suspected drug — less than 4 ounces in possession cases.

But that doesn’t mean that all law-enforcement will do so. Your municipal or county law-enforcement may still arrest you for possession of ma*****na. Hidalgo County has a pretrial dismissal policy in place for first time offenders.

Hopefully, Hidalgo County and the rest of the State will choose to punish these type of minor offenses by fine only.

Texas’ largest law enforcement agency is moving away from arresting people for low-level ma*****na offenses. It’s the latest development in the chaos that has surrounded pot prosecution after state…
