Yesterday, Attorney Evangeline Dhawan-Maloney argued a case before the U.S. Court of Appeals for the 8th Circuit: Ana Garcia Mejia v. Blanche 25-2902. The case involves an asylum denial where the BIA held that the persecution my client suffered, including repeated rapes from the age of 17, and an attempted forced abortion, was not "on account of" her gender, because she had not shown that her persecutor held a "generalized animus" towards women as a class. In doing so, the agency imposed a requirement that is inconsistent with the plain language of 8 USC §1158(b)(1)(B)(i). Although only a narrow issue is before the Court, the decision could have future consequences for women fleeing sexual violence and reproductive coercion, including forced abortion. Our client fled to the United States where she gave birth to her son, who is 7 years old. Evangeline was honored to speak on her behalf.
