IN THE NEWS | JLC Partner Kelly A. Guagenty was recently quoted by GBH in its reporting on allegations of abuse at a Cape Cod religious community and the fight to give survivors greater access to justice.

Kelly is helping survivors advocate for legislation that would give more survivors of child sexual abuse an opportunity to pursue civil claims.

“The science tells us that survivors of child sexual abuse often take decades to disclose. To deny those survivors access to the courts based on an arbitrary statute of limitations — it’s unfair.”

What does it mean to be trauma-informed?

For us, it means recognizing that the legal process does not happen separately from what a survivor has experienced.

It means listening without judgment. Communicating clearly. Giving clients information and choices. Understanding that trauma can affect memory, communication and decision-making. And avoiding practices that unnecessarily recreate feelings of powerlessness.

Trauma-informed lawyering does not change the legal standard or the facts of a case.

It changes how we work with the human being at the center of it.

The recent allegations involving a student at Cornell University are horrifying. And they raise a much bigger question:

How many students have to be harmed before universities stop treating sexual violence as a problem to manage instead of a responsibility to confront?

This is not just about one campus.

Across the country, students report sexual assault and misconduct only to encounter systems that can be slow to act, inadequate in their response, and more focused on protecting the institution than protecting the student.

Too often, consequences do not reflect the seriousness of the reported conduct. Too often, assault survivors are left carrying the burden while the institution moves on.

That is not accountability. And it is not acceptable.

Colleges and universities have a duty to take reports seriously, protect students from known risks and respond appropriately when harm occurs.

At Justice Law Collaborative, we take on powerful institutions when they fail in that responsibility. We stand with survivors and families seeking answers, accountability, and meaningful change.

Because a university’s responsibility to its students does not end when something terrible happens.

That is when it matters most.
