Monday January 13 - JURY RETURNS A NOT GUILTY VERDICT AFTER 6 MINUTES OF DELIBERATIONS. I represented a H.S., a UMASS student on a charge of Operating Under the Influence of alcohol. At 3:45 am, H.S. got out of bed and left her dorm room at the request of a friend who needed a ride home from a frat party. On the way to pick up her friend she struck a curd and blew out her tire. Within minutes a police officer arrived at the scene. The officer suspected OUI based upon the accident, blood shot eyes and an odor of alcohol. H.S. performed field tests on the side of the road. The officer opined she was intoxicated and arrested her. The jury did not agree. A not guilty verdict restores her driving privileges and saves H.S. from time consuming and expensive probation programs. NOT GUILTY OF 2 COUNTS OF R**E and 1 COUNT OF INDECENT A&B: On December 17, 2024, after 7 days of trial, a Hampshire County Superior Court Jury took just 2 1/2 hours to return a verdict of NOT GUILTY on two counts of R**e and one count of indecent Assault and Battery. My client, LK, was a UMass student when he was accused of the crimes. The Commonwealth alleged that he r***d a female UMass student who was too intoxicated to consent. The jury heard testimony of a defense expert on alcohol induced amnesia. The expert explained to the jury that a person can consume enough alcohol to lack memory of their actions but still present as sober or mildly buzzed at the time for which they have no memory. Video evidence, medical evidence and DNA evidence also helped to demonstrate LK's innocence. Special thanks to Dr. Christopher Rosenbaum for his assistance an his testimony.

ORANGE DISTRICT COURT JURY RETURNS NOT GUILTY VERDICT ON OUI, 2ND OFFENSE: My client, S.T. was charged with OUI, 2nd offense. The only prosecution witness was the arresting officer. He testified that he found my client in her car after an accident. He observed slurred speech, unsteady gait, blood shot eyes and an odor of alcohol. There was no evidence of breath testing and no field sobriety tests. Through cross examination, I was able to explain alternative causes for the accident and downgrade the other observations. EASTERN HAMPSHIRE DISTRICT COURT JURY RETURNS A VERDICT OF NOT GUILTY ON CHARGES OF ASSAULT AND BATTERY AND DISTURBING THE PEACE: On November 4, 2024, my client KD appeared in the district court in Belchertown, She was charged with Assault and Battery on a police officer and disturbing the peace. KD was captured on camera twice punching a female police officer while in the lock-up. The alleged assualt took place while three police officers were engaged in removing all of her clothes in a effort to "protect her from self harm." I argued that KD's actions were the result of a reasonable fear from excessive and unnecceray force. The jury agreed and returned NOT GUILTY findings on both charges. KD was facing a minimum sentence of 90 days if she were convicted.

JUDGE DIRECTS A FINDING OF NOT GUILITY ON CHARGE OF VIOLATION OF A RESTRAINING ORDER AFTER THE COMMONWEALTH RESTS ITS CASE: On Octber 3, 2024, my client appeared for a jury charge. My client AP was charged with violating a restraining order. After a jury of six had been impannelled, the Commonwealth presented its case. The Commonwealth called two police witness and a the alleged vicitm. Carefully crafted cross-examination of these witnesses were designed to demonstrate that there was insufficient evidence to support that charge. I was able to demostrate that the lack of police investigation made it impossible to determine if the defendant was inside or outside of the 100 yard stay away zone. After recessing for luch, the judge returned to the bench and declared a REQUIRED FINDING OF NOT GUILTY. A special thank you to RTW Investigations for assisting in this success.

NOT GUILTY ON CHARGE OF ASSAULT WITH A HANDGUN AFTER BENCH TRIAL: In September of 2024, I represented a client charged with assault with a handgun. My client, DC, was charged in a road rage incident. I prosecution alleged that in fit of road rage, DC pointed a hand gun at the alleged victim while friving on the Massachusetts Turnpike. DC elected a bench trial. Demanding cross examinations of the alleged victim and the arresting officer demonstrated significant inconsistences and weaknesses in the proving the elements. The judge returned a NOT GUILTY finding on the felony gun charge. DC, a nursing student, was saved from a likely jail sentece and a felony record. OUI CLIENT WITH 0.14 BAC FOUND NOT GUILTY AFTER NORTHAMPTON DISTRICT COURT JURY TRIAL: In December 2023, a jury of six persons returned a NOT GUILTY verdict against my client, JD. JD had been stopped on Rte. 9 near downtown Northampton. He informed the arresting officer that he was a TYPE 1 diabetic and that he was experiencing significantly fluxuating blood sugar levels. Despite having this information, the officer arrested JD. JD agreed to take a breath test at the police station and the BT macine reported a 0.14 BAC. At trial the officer admitted that diabetis could impact a BAC reading but was undable to explain what impact it would have. With this information presented to the jury, I was able to shoehorn REASON DOUBT into the minds of the jury. The jury quickly returned a verdict of NOT GUILTY on both the .08 per se theory and the impaired operation theory.

CLIENT FOUND NOT GUILTY OF R**E BY BERKSHIRE COUNTY SUPERIOR COURT JURY: On March 18-23, 2023 I tried a five day r**e trial. The defenadant, LDR, was charged with two counts of r**e of a aquentance at a house party. The complaining witness alleged that LDR trapped her in a basement bathroom were he r***d her. With the help of DNA Expert, ERIC CARITA, I was able to file motions that limited the govenment's evidence. The jury deliberated over two days and returned a unimous verdict of NOT GULTY on all charges.
