Monday January 13 - JURY RETURNS A NOT GUILTY VERDICT AFTER 6 MINUTES OF DELIBERATIONS. I represented a H.S., a UMASS student on a charge of Operating Under the Influence of alcohol. At 3:45 am, H.S. got out of bed and left her dorm room at the request of a friend who needed a ride home from a frat party. On the way to pick up her friend she struck a curd and blew out her tire. Within minutes a police officer arrived at the scene. The officer suspected OUI based upon the accident, blood shot eyes and an odor of alcohol. H.S. performed field tests on the side of the road. The officer opined she was intoxicated and arrested her. The jury did not agree. A not guilty verdict restores her driving privileges and saves H.S. from time consuming and expensive probation programs.
