A new federal rule,
effective March 16, 2026, from the Federal Motor Carrier Safety Administration (FMCSA) dramatically restricts who can hold a non-domiciled Commercial Driver’s License (CDL), limiting eligibility to H-2A, H-2B, or E-2 visa holders. This rule excludes roughly 200,000 drivers with valid employment authorization documents—including DACA, TPS, and asylum applicants—who will likely lose their licenses upon renewal, potentially forcing up to 97% of current non-domiciled CDL holders off the road.

Lawsuits are actively being prepared and filed against the U.S. government regarding the announced suspension of immigrant visa processing for approximately 75 countries, effective January 21, 2026. Lawyers are expected to argue that this pause is a violation of federal immigration statutes, the Administrative Procedure Act, and the Due Process/Equal Protection clauses of the U.S. Constitution.

🚨 What to Do If ICE Comes to Your Door 🚨

In uncertain times, knowing your rights is more important than ever. If ICE agents show up at your door, stay calm, stay inside, and know your legal protections.

✅ Before Opening the Door: ICE cannot enter without a signed judicial warrant. Ask them to slide the warrant under the door and start recording if it’s safe to do so.

📌 Checking the Warrant: Make sure it’s signed by a federal judge and includes the correct name and address. Remember, an administrative warrant (issued by ICE) does NOT grant them permission to enter.

⚠️ If They Have a Warrant: Do not resist. Stay as calm as possible, document everything, and contact a lawyer immediately.

🚫 If They Do Not Have a Warrant: You are NOT required to let them in. Politely refuse entry, do not answer questions, and state, “I am exercising my right to remain silent.
