A new federal rule,
effective March 16, 2026, from the Federal Motor Carrier Safety Administration (FMCSA) dramatically restricts who can hold a non-domiciled Commercial Driver’s License (CDL), limiting eligibility to H-2A, H-2B, or E-2 visa holders. This rule excludes roughly 200,000 drivers with valid employment authorization documents—including DACA, TPS, and asylum applicants—who will likely lose their licenses upon renewal, potentially forcing up to 97% of current non-domiciled CDL holders off the road.
