To my clients and friends, I'm sorry I have been slow to respond this week! I have been in trial and we hope to finish Monday (or Tuesday). Up to the jury, as these things go. I've tried to stay in touch with folks this week and I promise to get back to a more regular schedule once this is finished. Be well, everyone!

Excited to be helping out with the Hillsborough Regional for NC Mock Trial today. Thankful for a wonderful supporter in Mark Kleinschmidt, the Orange County Clerk of Court, who hosts us every year.

Also thankful for Carlos Mahoney and Brad Bannon for their generous sponsorship.

And finally a thank you to Rebecca Ugolick and Robby Jessup who come in every year to help out.

It takes a village, folks!

Many employers hire a third party entity to work to recoup health insurance benefits your insurance plan has paid on your behalf after a you have been injured. This might seem logical, at first, until you realize that you have been paying X dollars monthly for premiums for that plan. The plan reaps a windfall.

The primary entity employers and health insurance companies use is a company called the Rawlings Company. Here is a good article on their business practices. Companies and local governments (think city and county) hire them, then they get a cut of what they recoup, so there is zero incentive to think of you, as the injured party.

George Rawlings grabs a stack of computer printouts and stretches them six feet across his office, admiring data from police reports of Florida auto

Folks, I was fortunate enough today to get to argue a motion in the Old Orange County Courthouse. It was great fun to serve in that historic building.

With a new year, comes another North Carolina Mock Trial Program and it's just around the corner. I'm organizing the Hillsborough Regional this year, where Orange County Clerk Mark Kleinschmidt has graciously allowed us to use the courthouse again.

If you are a local attorney or judge, and would like to help us, the link is here, you can sign up online: https://ncmocktrial.org/get-involved/

I'm so proud to be a part of this program and it can't be overstated how meaningful it is to these kids. We'd love to have you!

Get involved with the competition by donating, coaching, partnering, or judging!

So many of us in the legal community this week are mourning the passing of Janet Ward Black. She was an excellent lawyer, and a better person. Smart, compassionate, generous, trailblazing, faithful: these are but some of the adjectives to describe her. What an impact and what a legacy. She will be greatly missed. May God grant her family and staff peace in this difficult time.

State Farm requires you to file claims online these days. When you have certain information the system asks you to provide that doesn't fit into their auto-populated fields, it shuts you down, won't let you continue, and asks you to call in. Then, their phone team instructs you to file claims only through the online system. It's a circle of misery. problems.

I haven't posted on social media in quite some time, in part because it can be so disheartening. In my efforts to do better, I bring you the amount of documents one may have to deal with when filing a "simple" (note, there is no such thing) lawsuit.

Yes, I am aware we have mandatory electronic filing now.

I have gotten a few questions about why "people who have never lived in NC" are allowed to vote here, as it relates to the Griffin/Riggs race (note, they're allowed to vote in all the other races apart from the Griffin/Riggs race as well).

In an attempt to educate, let me articulate that legal answer. Also, note, I don't care about your political reasons, which are exactly that: political reasons.

The answer is because North Carolina's General Statutes, passed by the legislature, specifically allow it. Article 21A covers the scenarios and definitions of who constitutes an NC Voter, and indeed, in certain (very limited) circumstances, a voter can vote in NC despite never having lived here (see Section 163-258.2).

Be aware it's a minuscule number of people. The theory is that there are certain US Citizens (who must be allowed to vote) who have lived abroad for years for work, military service, etc., and have either never registered in another state, have lived with parents and are now adults themselves, or are ex pats. So now you know.

Excited to be helping so many other fine people run the North Carolina Mock Trial Program High School Mock Trial State Finals this weekend in Raleigh at Campbell School of Law. We have teams from across the state coming in, along with distinguished judges and lawyers who are volunteering their time to help make things go. It will be a long, but rewarding weekend! Good luck to all the competitors this weekend!
