Do you need help changing your visitation/parenting time schedule?

The visitation schedule will depend on the specific circumstances of the case, including the child’s age, the parents’ schedules, and the distance between the parents’ homes. In most cases, the court encourages frequent and meaningful contact between the child and both parents, unless there are safety concerns, such as domestic violence or substance abuse.

How Child Support is calculated in Ohio:
Child support is calculated using a statutory formula that takes into account the gross income of both parents, the number of children, and other relevant factors. The calculation is based on an “income shares” model, which assumes that the child should receive the same proportion of parental income that they would have if the parents had not separated. Gross income and income calculation in the Ohio Revised Code § 3119.01(C) defines gross income as all earned and unearned income from all sources. This includes:
Wages, salaries, and commissions
Pension and retirement income
Self-employment income
Social Security benefits (excluding SSI)
Bonuses and overtime
Rental income and other passive income
Unemployment benefits
Spousal support received from another party
Workers’ compensation
Gross income does not include certain one-time payments or benefits, such as public assistance, Supplemental Security Income (SSI), or child support received for other children. Additionally, self-employed individuals must report their net business income, which accounts for reasonable business expenses.

Legal Procedure for a Post-Decree Modification:

To initiate a post-decree modification in Ohio, the following steps are generally involved:
Filing A Motion: The party seeking the modification must file a motion with the court that issued the original decree.
Service Of Process: The motion must be served to the other party, providing them with notice and an opportunity to respond.
Hearing: The court will schedule a hearing where both parties can present evidence and arguments.
Decision: The judge will issue a decision based on the evidence presented and the applicable legal standards.

In many ways, filing a motion to modify a parenting or divorce decree can feel like starting a whole new court case, especially if you are asking for a change in custody rights. It is not uncommon for heavily contested modification cases to last as long as a year or sometimes even longer. But, many times an experienced family law attorney can help identify ways to solve the problems that have come up, negotiate with the other party or their attorney, and reach agreements that help bring everything back to a status quo. If that fails, an experienced family litigation attorney will not be afraid to argue for you at trial to make sure the new court order accomplishes what is best for your children.
