For most people August represents the "dog days of summer," vacation with family and friends, time by the pool, and maybe a picnic if it's not too hot.

For estate practitioners, August represents one more thing...Make-a-Will month. Yes the estate planning community celebrates the entire month by reminding families and individuals that don't have a Will to stop waiting and contact an attorney to get the process started.

You have intentions to take care of loved ones should something unforeseen happen to you, but unless it's in writing in a Will your intentions don't mean a whole lot.

As families prepare to send their first child off to college this summer there are lots of things that need to get done. One of the important things to add to the "To-Do" list is a medical directive (or Healthcare Power of Attorney). Your college student is now an adult and their medical information is protected by HIPAA privacy laws. In addition, if your adult child requires medical attention or hospital care while away at college parents should have a Healthcare POA that gives them access to their child's medical records and also gives a parent the authority to make healthcare decisions for their adult child if that child is unable to do so while receiving medical treatment.

It is recommended the adult child appoints a parent (mom or dad) to act as their healthcare proxy, and name the other parent or a family member as a back-up to the parent if they are unable or unavailable to act on behalf of the adult child. This planning applies to families with multiple children in college.

If you have an estate plan that’s good planning, but how long has it been since the plan was created? When was the last time you looked over your Will, Trust or Power of Attorney? What’s changed in your life since the plan was put into place?
I recommend an estate plan review every 4-5 years (or sooner if there have been life changes) to ensure the plan still works for you and your loved ones.

At one time or another we've all had a passing thought about an asset we own and how to pass that asset on to loved ones if something happens to us. The good news is there are several ways to do it.

Assets can be transferred by:
- Beneficiary Designation
- Joint Tenant with Right of Survivorship
- Transfer on Death (TOD)
- Trust
- Will
