Mike’s Rule #7: See a doctor right away after an accident, even if you feel fine.

Some of the worst injuries show up days later. Injuries can have a delayed onset, so feeling okay at the scene doesn’t mean you’re in the clear (especially with all that adrenaline running, which might mask an injury). Get seen quickly so your injuries are diagnosed early and on the record.

Waiting is the gap the insurance company uses to argue you weren’t really hurt.

Mike’s Rule #6: Don’t admit fault at the scene.

Don’t apologize. Don’t speculate about what you think happened. There’s a lot of evidence to sort through before anyone can say who’s responsible and a guess in the moment can be used against you later.

That adrenaline will be pumping and it’ll tell you you’re fine, but you don’t know that until you’ve been checked out. So take a breath and stay calm. Saying nothing is often the smartest thing you can do.

By now you’ve probably seen it. A bull bison at Yellowstone launching a man 8 feet in the air.

So, who’s liable when an animal hurts someone?

Animals fall under strict liability, which means the owner can be on the hook even if they didn’t do anything. Who counts as the responsible owner depends on where it happens:

Fenced in: the animal’s owner has a duty to fence their property and keep their animals contained. If one gets out and hurts someone, that’s on the owner.

Fenced out: the burden flips. It’s on everyone else to fence the animals out of their own property. If you don’t, the animal’s owner may not be liable.

This bison incident happened on national park land, so the owner is the federal government. They are shielded by governmental immunity, so, as wild as this video is, there’s likely no claim at all.

Mike’s Rule #5: Document the scene before you leave.

Photos of the weather, road conditions, any signs, and everything else in your vicinity. If witnesses stopped, grab their name and number. The best time to get evidence is right then, not later. It can be completely gone once you drive away.

Rule #4: Always collect the other driver’s info at the scene.

If you can, let the police pull it for you. If they can’t come, get it yourself:

- Photo of their driver’s license
- Photo of their insurance card
- Photo of their license plate
- Their address and phone number

Skip this and you’re stuck if they decide to stop cooperating later. Two minutes at the scene can save you months of chasing someone down.

Mike’s Rule #2: Always call 911.

Assume the other person will not do this immediately, so go ahead and call 911. Even if you’re not hurt, call them so you can get a police report (important for later in the case).

An ambulance ride can be expensive, but what’s more expensive and hurtful to your case is waiting to go to the hospital when injured. Don’t wait.
