🚨 NEW U.S. Citizenship and Immigration Services POLICY: (May 22 2026 Update)

Who Can STILL Adjust Status in the U.S.?

If you are in the U.S. on a visa and thinking about a Green Card—this is the most important takeaway:

⚖️ ✅ THE GENERAL RULE
👉 Most people must apply for a Green Card from outside the United States.
USCIS clarified that:
• Adjustment of Status (filing inside the U.S.) is not the normal process
• It is an extraordinary, discretionary benefit
• The system expects most applicants to go through consular processing abroad

📌 In simple terms:
➡️ Temporary visas (student, tourist, work visas) are meant to be temporary
➡️ Most people are expected to leave the U.S. and apply at a U.S. Embassy

⚠️ EXCEPTION: When CAN someone stay and apply inside the U.S.?
Adjustment of Status still exists—but it is now treated as a rare exception

👉 You must show“unusual or outstanding equities” to justify staying in the U.S.

✨ WHEN TRAGEDY, MISSING RECORDS, AND IMMIGRATION LAW COLLIDE—HOPE STILL EXISTS✨

Atty. Jane Dixon recently appeared before the EOIR Immigration Court in Miami, Florida, advocating for a widow whose journey through the immigration system was derailed by circumstances entirely beyond her control.

The widow lawfully entered the United States on a J-1 Exchange Visitor visa and remained in legal immigration status when she later fell in love and married the deceased.

After marrying a U.S. Citizen, the couple intended to file immigration paperwork—but his struggles with addiction and serious financial hardship delayed the process.

Tragically, he passed away before any I‑130 petition or I‑485 adjustment of status could be filed.

Following his death, the alien widow, acting on her own and in good faith, filed an I‑360 self‑petition as the widow of her deceased U.S. citizen husband, relying on the protections the law provides to surviving spouses.

📌 The petition was denied—not because the marriage was invalid or fraudulent—but because USCIS required a divorce decree from the husband’s prior marriage, a fact the widow never knew at the time of marriage and did not know how to obtain after his passing.

Despite her honest efforts, she was unable to comply with the Request for Evidence within the allotted time.
As a result, her case was referred to Immigration Court and placed into removal proceedings.

⚖️ There is a renewed opportunity.
The Immigration Judge continued the case until 2028, giving our office the critical time needed to properly prepare relief—including a renewed I‑360 filing that can serve as a defense to removal and a foundation to seek deferral or dismissal of deportation proceedings.

💜 This case is a powerful reminder:
• Immigration law still protects widows
• Missing records can be addressed with the right legal strategy
• Removal proceedings are not always the end of the story.

✨ MEDIATION WIN — PROPERTY SAVED, JAIL AVOIDED ✨

Another reminder that the right legal strategy can change everything.

Atty. Jane Dixon, Founder of Allied Law Services, PLLC, is proud to share the successful mediation of a boundary dispute case in which her client faced a serious risk of contempt of court — including possible jail time — for alleged noncompliance with a prior court order.

When Atty. Jane stepped in, the situation was already difficult:
▪️ A final court order had awarded a 20‑foot strip of land in favor of the opposing party
▪️ That strip cut into the client’s property
▪️ The client’s pole barn was at risk of being destroyed, along with the loss of its use and materials.

Instead of allowing the case to spiral into punishment, Atty. Jane:
✅ Responded strategically to the opposing party’s Petition for Contempt of Court
✅ Asserted legal and equitable grounds showing why incarceration was not warranted
✅ Redirected the dispute into court‑ordered mediation, focused on resolution—not destruction.

📄 The result?
According to the Mediator’s Report, the parties successfully resolved the contempt petition in mediation on April 23, 2026, with a settlement reached and formal documents to follow—preserving the client’s rights and avoiding jail.

💡 Why this matters:
Contempt cases are serious. They can involve fines, loss of property, and even jail time. But contempt is not automatic, and boundary disputes require careful legal analysis, due process, and strategic advocacy.
