📚 Fact Friday | Trick or Truth?
🎃 “If I have a Will, my family won’t need Probate.”
TRICK.
This is one of those estate-planning misconceptions that sounds logical—but having a Will does not automatically mean your estate will avoid probate.
A Will provides instructions for what you want to happen after your death. But depending on what you own, how your assets are titled, their value, and whether other estate-planning tools are in place, a court proceeding may still be necessary.
Think of it this way:
🍂 A Will can give instructions.
⚖️ Probate is a legal process.
Having the first doesn’t automatically eliminate the second.
Some assets may pass outside of probate through other arrangements, such as a properly funded Living Trust, certain beneficiary designations, survivorship ownership, or other transfer methods. What applies depends on the asset and individual circumstances.
💜 Lisa’s Takeaway:
A Will gives instructions. It doesn’t automatically skip probate.
Estate planning isn’t just about having a document. It’s about understanding how your documents, property ownership, and beneficiary arrangements work together.
